A RESOLUTION DECLARING THE BOARD OF
ADJUSTMENT, CREATED BY ORDINANCE NO. 1-64,
_ REPEALED AND APPOINTING A NEW BOARD OF
ADJUSTMENT PURSUANT TO CHAPTER 176, FLORIDA
STATUTES
WHEREAS, the terms of office, powers and duties of the
Board of Adjustment created by Ordinance No. 1-64 of the
City of Tamarac are inconsistent with the provisions of
Chapter 176 FLORIDA STATUTES, and
WHEREAS, Section 125 of the new City Charter provides that
the provision of Chapter 176, FLORIDA STATUTES shall apply to
the City in the exercise of its powers in planning and zoning,
and
WHEREAS, the City Attorney has given his opinion that
the new charter has the effect of repea�;ing Article VI of
Ordinance No. 1-64;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
City of Tamarac, Florida:
SECTION 1: That the Board of Adjustment created by
Ordinance No. 1-64 of the City of Tamarac be deemed abolished
and the offices declared vacant.
SECTION 2: That a new Board of Adjustment be appointed
pursuant to Chapter 176, FLORIDA STATUTES, for a term of
three years and removable for cause in the manner stated in
Chapter 1762 such members to serve without compensation.

, be and they are hereby appointed as
members of the Board of Adjustment of the City of Tamarac,
with the powers and duties enumerated in Chapter 1762 FLORIDA
STATUTES.
