RESOLUTION" NO.
WHEREAS, the City Council deems it in the best interest of the
general community to acquire the sewer and water systems and facili-
ties owned by Tamarac Utilities, Inc., and
WHEREAS, the City Council had previously authorized the exploration
of methods of acquisition of the said sewer and water facilities
by a committee of the Council and the City Attorney, and
WHEREAS, said committee has now recommended to the Council that
steps be immediately taken towards acquiring the said sewer and
water facilities, and
WHEREAS, the City Council is now desirous of authorizing certain
procedures to initiate the acquisition of the sewer and water systems.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
City of Tamarac, Florida:
1. The City'Council does hereby express its intent that the
ownership of the sewer and water plant and facilities now owned by
Tamarac Utilities,Inc., should be acquired for the benefit of the
City and its residents.
2. That Maygr Wilderman is hereby authorized and instructed to
enter into negotiations with the owners of the aforesaid sewer and
water systems and to continue explorations of the best possible
methods of acquiring same.
3. That in the event that the owner of the systems fails or
refuses to negotiate in good faith, the City Council does hereby
declare its intent to examine the -possibilities of acquiring the
system through condemnation proceedings.
_4. That upon the recommendation of the committee previously
appointed, it is necessary for the Council to appoint and authorize
a bond underwriter and, upon the recommendation of s�.id committee,
the Council;does;hereby appoint and authorize Bache & Co.,
as the bond underwriter for the acquisition of the sewer and water
facilities as aforesaid, for the benefit of the City.
5. The Council further wishes to express its intent that in
pursuing the acquisition of the aforesaid sewer and water systems
no authorization is included for the expenditure of any funds
of the City for any of the aforesaid purpo7ay
