A RESOLUTION AWARDING A CONTRACT FOR CANAL
CLEANING TO LAKES AND WATERWAYS MANAGEMENT
SERVICE, (LAWMS), 3M COMPANY, FOR CANAL
CLEANING AND PROVIDING FOR THE FUNDING
THEREOF.
WHEREAS, the City Council deems an emergency to exist with
respect to unsanitary and dangerous conditions in the canals of
the City caused by an overabundance of vegetation, and
WHEREAS, the City has heretofore advertised for bids for such
canal cleaning and has received no bids, and
WHEREAS, the Council has heretofore appointed a committee to
investigate this problem and report back and such committee has
recommended a contract with LAKES AND WATERWAYS MANAGEMENT SERVICE,
(LAWMS), 3M Company, and
WHEREAS, The Council desires for the funding of such contract
within the budget requirements of the City Charter,
NOW THEREFORE BE IT RESOLVED BY THE COUNCIL of the City of
Tamarac:
SECTION 1: That the Council authorizes the Mayor and City
Manager to enter into a contract with LAKES AND WATERWAYS
MANAGEMENT SERVICE, (LAWMS), 3M Company, hereinafter called
LAWMS, a copy of which is attached hereto and made a part hereof
by reference.
SECTION 2: That notwithstanding any language to the contrary
in the attached agreement, the City shall be entitled to full
value in services or a pro rata refund for the monies paid to
LAVW in the event that the contract is terminated by either
party for any reason whatsoever.

Dear Mr. Decker:
Per your request of today, Monday, May 17, 1971, we are
' herewith sending you a new Water Management Agreement
to provide a means for handling your emergency flood
control problem. You will note that the new agreement
covers a three (3) month period, but contains an option
to pick up the twelve (12) month or twenty-four (24)
month proposals which were sent to you on May 3, 1971.
If you have any questions concerning the new agreement,
please let me know. I will be out of town the next few
days, but will be in constant touch with my answering
service in case you call.

WATER MANAGEMENT AGREEMENT
THIS AGREEMENT made this day of 19_, is between LAKES AND WATERWAYS MANAGE-
MENT SERVICE, MINNESOTA MINING AND MANUFACTURING COMPANY, hereafter called "LAWMS" and
City of Tamarac , hereafter called "CUSTOMER".
The parties hereto agree as follows:
A. LAWMS agrees to manage certain lakes and/or waterways for a period of three i 3) months from the
date of commencement of treatment so as to control aquatic vegetation in accordance with the following schedule of areas and
charges:
AREA CHARGE
City of Tamarac Canals $6,450.00
Mainlands I -IV
*Customer hereby has the option of extending
this AGREEMENT for (a) an additional nine (9)
months for an additional fee of $5,800, or
(b) an additional twenty-one (21) months for
an additional feeof $15, 800, according to,"""''''
the AGREEMENTS supplied to the City of
Tamarac by LAWMS on May 3, 1971, providing
customer so notifies LAWMS in writing at
least thirty (30) days prior to expiration
of this AGREEMENT.
TOTAL:
CUSTOMER agrees to pay to LAWMS the agreed upon sum as designated above in the following manner: $
shall be due and payable on or before the date of commencement of treatment; the balance shall be payable in equal and consecutive
quarterly installments. '
"City will be billed for full amount once initial major
treatment is completed.

In addition CUSTOMER agrees to pay any taxes, including Sales Taxes, fees or charges that are imposed by any governmental body
relating to the service provided under this AGREEMENT.
B. LAWMS agrees to use only products with a demonstrated wide margin of safety to fish and wildlife and which are approved
for use in the State of Florida.
C. LAWMS agrees to commence treatment within ten (10) days (weather permitting) from the date
of execution of the AGREEMENT provided, however, that unless accepted by CUSTOMER and returned to LAWMS by or before
June 1 , 19 lthe offer contained herein is withdrawn and this AGREEMENT shall have no
A further force and effect unless the provisions of this paragraph are expressly waived in writing by an authorized representative of
LAWMS.
D. The terms and conditions appearing on the reverse side hereof form an integral part of this AGREEMENT, and CUSTOMER
hereby acknowledges he has read and is familiar with the contents thereof.
