CITY OF TAMARAC, FLORIDA
RESOLUTION #—�14
WHEREAS, pursuant to Resolution #70-47 the City of
Tamarac entered into a contractual relationship with Lawn Valet
Service, and
WHEREAS, said contractual relationship requires Lawn Valet
Service to provide maintenance functions to individual lots and
recreational areas within the City of Tamarac,all of which do
not include the maintenance and repair of sprinkler systems,
and
WHEREAS, the City Council of the City of Tamarac has expressed
its intent to divorce, divest and otherwise terminate its responsi-
bilities and obligations to perform maintenance functions inclusive
of those that are the contractual obligations of Lawn Valet Service,
and
WHEREAS, all of the aforementioned contractual relationships
and obligations in regard to maintenance functions have been and
are entered into by the City in its proprietary capacity and not in
its capacity as a municipality or governmental authority, and
WHEREAS, the City Council is desirous of doing everything
between now and the date of termination of its obligations as
aforementioned to improve the sprinkler systems in those areas
of the City affected, and
WHEREAS, because of surrounding circumstances and effects
of a sprinkler system that is in need of maintenance and repair
and because of the Council's expressed intent to divest itself
and terminate maintenance functions in the very near future
an emergency situation has been created whereby the maintenance
and repair of the sprinkler system is a pressing and an immediate
necessity, and
WHEREAS, the present facilities available to the City of
Tamarac do not make provision or provide for the aforementioned

repairs and maintenance, and
WHEREAS, any obligation that might be entered into for
the maintenance and repair as aforesaid shall only be as a very
temporary nature, and
WHEREAS, the City Manager has recommended to the City
Council that a change order or amendment to the existing con-
tractual relationship with Lawn Valet Service would be the best
available immediate source and manner in which all of the afore-
mentioned requirements and circumstances might be satisfied, and
WHEREAS, the City Council is now desirous of authorizing
a change order evidencing the retention of the additional
services of Lawn Valet Service for the purpose of providing the
aforementioned required sprinkler maintenance and repairs.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
City of Tamarac, Florida:
1. That a change order is hereby approved in that
contractual relationship between the City of Tamarac and Lawn
Valet Service. Said change order shall be to the effect that
Lawn Valet Service, beginning with the 15th day of January, 1971,
and continuing through the 31st day of March, 1971, shall be
responsible and have the obligation to provide sprinkler system
maintenance, repairs, and to place the sprinkler systems in
operable condition. Said responsibilities shall apply to all
lots, recreational areas and other areas covered by the all ready
existing contractual relationship between Lawn Valet Service
and the City of Tamarac.
2. As and for compensation for the aforesaid services,
Lawn Valet Service shall be paid the sum of $1.00 for each lot
included in the aforementioned contractual relationship for
the period January 15th through January 31, 1971. Thereafter
for the months of February and March, compensation shall be

in the sum of $2.00 per month per lot covered by the afore-
mentioned contractual relationship. Said sum of $2.00 per
month shall be paid in equal parts four times per month.
3. Any sections, lots or other areas of the City that
have already or during the pendency and term of this change
order become divested and no longer the responsibility for
maintenance of the City of Tamarac shall be deleted in computing
the compensation set forth herein.
4. Compensation for the period January 15th through
January 31, 1971, shall be paid to Lawn Valet Service immediately
following the passage of this Resolution.
5. A copy of this Resolution in its entirety, when properly
executed by the Mayor and City Manager in behalf of the City
of Tamarac and by Lawn Valet Service, shall act as evidence
of this change order and the intent created hereby.
