CITY OF TAMARAC, FLORIDA
RESOLUTION NO.
A RESOLUTION AUTHORIZING AN AGREEMENT WITH CALVARY
BAPTIST CHURCH FOR SEWAGE DISPOSAL SYSTEM IMPROVEMENTS
AND HOOK-UP.
WHEREAS, the City is the owner and operator of a sewage
disposal plant and collection system in the vicinity of the
Church property, and,
WHEREAS, the Church needs the use of such facility in
order to proceed with construction of new church and school
buildings, and,
WHEREAS, the City is authorized by its charter to provide
such facilities, but the existing system is operating at peak
capacity, and,
WHEREAS, the Church has offered to construct certain additions
and improvements, to the sewage disposal system, at its expense, in
exchange for the right to hook-up to said system,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE City of
Tamarac, Florida:
SECTION 1: That the agreement between the City of Tamarac and
the Calvary Baptist Church, a copy of which is attached hereto, be
and the same is hereby approved.
SECTION 2: That the Mayor and City Manager are hereby authorized
to execute said contract on behalf of the City.

WHEREAS, the Church needs the use of such -Facility in order to
proceed with construction of neiv church and school buildings, and,

such facilities, but the existing system is operating at peak
capacity, and,
WHEMAS, theChurch has offered to construct certain additions
. and improvements, to the sewage disposal systems at its exj)ense,
in exchange for tho right to hook --up to said. system,
IT IS therefore, in consideration of the premises and of the
mutual promises contained herein, agreed as follocrs:
1. That the Ctiurch shall make and pay for whatever
modifications necessary to increase the treatment capacity of the
City's Sewage Treatment Plant to a minimum of 160,000 gallons
per day as outlined in their letter of May 25, 1972. The cost of
which shall include all engineering, inspection, testing, labor,
equipment, materials and all -else incidental thereto.
2. Any and all modifications to said plant shall be in
full compliance with the State of Florida Department of Pollution
Control standards and regulations.
3. The Church shall indemnify the City against loss or
damages resulting from the proposed work.
4. The City, through its Engineer and Manager, shall.
approve all plans prior to the commencement of any wort; on the
proposed modification.

three years from the time of completion of the proposed modifications.
6. The Church shall. Lot be allowed to make connection
to said plant until the proposed niodif:i.cations have been completed
and accepted, in writing, by the CiLy Engineer.
7. The City shall provide sewage trcat)iient capacity for.

8. That the Church shall indemnify and save the City
harmless from all claims arising out of the foregoing construction.

improvements shall be determined by the City Engineer prior to
commencement. Withdrawals front such fund shall be r,,ade only in
accordance with work progress for the purpose of paying for ivaterial
and labor. All such withdraiaal.s shall be approved by the City
Engineer prior to payment.
9. The Church agrees to furnish the City with Workman's
Compensation insurance certificates prior to commencement as well
as certificates of liability insurance with limits of not less
than $100,000.00 for each.person injured and $300,000.00 for each
occurance .
10. The Church further agrees to comply with all applic-
able Laws and sanitary and building codes and to make payments to
contractors, labornrf7 an.J m-it eri,alrie- in 9r.co-rd -tee withthe
mechanic's lien Laws of the State of Florida.
11. In consideration of the foregoing the City agrees

to waive all hook-up charges in connection wiLA t:lic
improvements to the Church property. Nothing herein shall waive
any charges for work commenced more than three years subsequent
