CITY OF TAMARAC, FLORIDA
RESOLUTION NO.
WHEREAS, Texaco Inc. heretofore applied for and obtained
zoning for a service station site at the intersection at McNab
Road and University Drive by action by the Board of County
Commissioners, Broward County, Florida, and
WHEREAS, pursuant to such action the building permit was
issued to Texaco Inc. by the building department of Broward County,
Florida, for a service station on such site, and
WHEREAS, the City of Tamarac, upon learning of such action
protested the issuance of the zoning and building permit, due
to the fact that the subject site was within the corporate limits
of the City of Tamarac and as a result of such protest Broward
County suspended such permit, and
WHEREAS, the City of Tamarac has determined that both Broward
County and Texaco Inc. acted in reliance on the failure of the
- City of Tamarac to properly adopt an official city map and upon
the inadvertent omission of the subject property from the boundaries
set forth in the new City Charter, and
WHEREAS, the parties are in agreement that Chapter 166
Charter Board was without authority to alter the boundaries within
the City, but that the property owner relied on such statement
of facts to its detriment, and
WHEREAS, Texaco Inc. has agreed to abide by the Ordinances,
taxes and license fees of the City in accordance with the letter
addressed to the City Attorney dated October 19, 1972, attached
hereto and made a part hereof and marked Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE City of
Tamarac, Florida:
SECTION 1: That the City Council of the City of Tamarac
does hereby withdraw its objections to the building permit issued
by Broward County to Texaco Inc. for a service station at the
intersection of McNab Road and University Drive and authorizes
Broward County to reinstate such permit and to provide inspections
and certificate of occupancy in accordance with the rules and
regulations applicable to the building department of Broward
County, Florida.
SECTION 2: That copies of this Resolution shall be furnished
to Texaco Inc. and to the building department of Broward County.

Dear Mr. Ford:
In consideration of the City of Tamarac's with-
drawal of its objection to the building permit issued by
Broward County for this site, Texaco agrees not to assert
any claim for damages against the City occasioned by the de-
lay in construction and use of this station. Further, Texaco
and the operators of this station will recognize the ordi-
nances of the City of Tamarac and will pay taxes and license
fees to the City.
