HomeMy WebLinkAboutCity of Tamarac Resolution R-72-078This Was introduced I CITY OF TAMARAC, FLORIDA RESOLUTION N0.��,�j Temporary No. 17 A RESOLUTION DECLARING THE INTENT OF THE CITY COUNCIL TO HONOR THE CLOSING HOURS OF EXISTING BUSINESSES DEALING IN ALCOHOLIC BEVERAGES IN AREAS HERE- AFTER ANNEXED TO THE CITY OF TAMARAC. WHEREAS, the City of Tamarac has heretofore enacted Ordinance No. 72-7 providing for existing zoning clas- sifications to remain in effect as to any lands hereafter annexed into the City of Tamarac, and WHEREAS' it was the intent of such ordinance to recognize the existing rights of property owners being annexed into the City and to define the circumstances under which such zoning might be changed, and WHEREAS, Ordinance No. 71-35 of the City of Tamarac established the closing hours for establishments serving alcoholic beverages for consumption both on and off the premises in the City of Tamarac and such closing hours are more restrictive than the Broward County closing hours, and WHEREAS, it is the desire of the City Council to clarify the rights of owners of such establishments, in the event that they should be annexed into the City of Tamarac, NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE City of Tamarac, Florida; r- r] SECTION 1: That the closing hours of Broward County as they now exist or as they may hereafter be restricted for sale, service and distribution of alcoholic beverages both on and off the premises shall continue to apply to all establishments annexed into the City of Tamarac subsequent to the date of this Resolution. SECTION 2: That such closing hour's shall remain in effect so long as the existing license or any renewal thereof shall be located at its present place of business. Provided, that should Broward County amend its closing hours, the owner or operator may elect, by notice in writing addressed to the City Clerk, to abide by the City closing hours, and, in that event, such establishment shall thereafter be bound by the closing hours of the City of Tamarac. SECTION 3: That in all other respects such establish- ments shall be bound by and shall be subject to all of the ordinances, rules and regulations of the City of Tamarac.
