CITY OF TAMARAC, FLORIDA
RESOLUTION NO. 72-85
A RESOLUTION URGENTLY REQUESTING EXECUTIVE
OR LEGISLATIVE ACTION TO ASSUME RESPONSIBILITY
FOR REVIEWING, REGULATING AND CONTROLLING
BIDDERS, BIDDING PROCEDURES, BID PRICING AND
COSTS RELATING TO CONSTRUCTION OF ENVIRONMENTAL
CONTROL, WATER DISTRIBUTION AND WASTE DISPOSAL
SYSTEMS IN ORDER TO ALLEVIATE GREATLY INCREASED
FINANCIAL BURDENS IMPOSED UPON OUR CITIES IN
UNDERTAKING TO COMPLY WITH ENVIRONMENTAL PRO-
TECTIVE LAWS OF THE STATE OF FLORIDA; REQUESTING
AN INVESTIGATION INTO SAID PROBLEMS AND A CON-
FERENCE IN REGARD THERETO.
WHEREAS, the Legislature of the State of Florida
enacted in 1967 Chapter 403, Florida Statutes, known as the
Florida Air and Water Pollution Control Act, which has been
subsequently amended to provide advanced standards for
sanitary sewage disposal; and
WHEREAS, said Act declares that the prevention,
abatement and control of pollution of the air and waters of
the State of Florida are affected with a public interest within
the purview of the State's police powers to insure the health,
peace, safety and general welfare of the people of the State;
and
WHEREAS, the .legislative requirements embodied in
the legislative intent of said Act and enforceable through its
provisions involve the expenditure of hundreds of millions of
dollars for the installation of machinery, equipment and
facilities for the treatment of polluting waste and place
upon our cities the responsibility for planning and con-
structing systems which will best insure abatement of pollution
and proper treatment and disposal of waste in compliance there-
with; and

WHEREAS, said Act is administered by the Depart-
ment of Air and Water Pollution Control, requires advanced
waste treatment by January 1, 1973, and provides penalties
for failure to comply, thus necessitating implementation of
such advanced treatment by the cities on an emergency basis
in many cases, resulting in major construction and installa-
tion programs being undertaken by our cities; and
WHEREAS, the type of construction and installation
is of a highly specialized nature, and the number of firms
qualified to undertake such construction contracts is
limited, thus creating an increased cost problem and con-
sequent burden upon the inhabitants of our cities such that
in many cases despite competitive bidding procedures used by
our cities the bids received for construction and installation
of these facilities exceed expert estimates by several millions of
dollars; and
WHEREAS, the City of Tamarac is fully aware of this
problem and has determined that an emergency exists which must
be acted upon immediately in order to preserve the public
health, welfare and safety of the citizens of the State of
Florida as well as the economic stability of our cities making
it necessary to seek means to find a solution which will inure
to the best interests of all concerned and assure timely com-
pliance with applicable law;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF TAMARAC:
1. That the City of Tamarac supports the intent and
purpose of our laws enacted to protect our environment, and
those efforts designed to accomplish the abatement of pollu-
tion thereof in an efficient and orderly manner which will
best serve the inhabitants of our cities who must ultimately

bear the burdens of the benefits realized in the preservation
of our waters and skies. To this end, the City of Tamarac
urgently requests executive or legislative action requiring
that the Department of Air and Water Pollution Control or
such other established State governmental department as may
be deemed appropriate by the Governor, shall assume re-
sponsibility for reviewing, regulating and controlling
bidders, bidding procedures, bid pricing and costs relating
to construction of environmental control, water distribution
and waste disposal systems in order to alleviate the greatly
increased financial burdens which have been and will be im-
posed upon our cities in undertaking to comply with our laws
and accomplish the goals sought thereby.
