CITY OF TAMARAC, FLORIDA
RESOLUTION NO. c
A RESOLUTION AUTHORIZING THE PAYMENT OF $35,000.00
FROM THE UTILITY FUND TO THE BOARD OF COUNTY COMMISSIONERS,
BROWARD COUNTY; FLORIDA, IN SETTLEMENT OF THE SUIT OF
BROWARD COUNTY AGAINST THE CITY OF TAMARA.C.
WHEREAS, Broward County has heretofor sued the City of
Tamarac for water and sewer service in the sum of $98,624.62, and
WHEREAS, the City has offered to settle such suit for the
sum of $35,000.00 and such offer has been accepted by the Board of
County Commissioners of Broward County, Florida, and
WHEREAS, the City Auditor has certified that such funds have
been collected by the City of Tamarac from the residents and have
not been paid over to Broward County,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE City
of Tamarac, Florida:
SECTION 1: That the appropriate City Officials are hereby
authorized and directed to pay over to the Board of County Comm-
issioners of Broward County, the sum of $35,000.00 in full settlement
and satisfaction of the claims of Broward County against the City
of Tamarac in case No. 71-2075 in the Circuit Court of Broward
County, Florida.
SECTION 2: That the City Attorney is authorized to deliver
such check upon receiving a Motion signed by the County Attorney
dismissing the suit of Broward County with prejudice.
