RESOLUTION NO.
RESOLUTION AUTHORIZING THE CITY ATTORNEY
TO ACT ON CERTAIN MATTERS RELATING TO THE
CHARTER AND THE CHARTER BOARD OF THE CITY
OF TAMARAC.
WHEREAS, The City Attorney has given his opinion that
under the terms of Florida State Statutes, Section 166,
the Charter Board of the City of Tamarac was illegally
constituted from May 18, 1971, until February 27, 1973,
and
WHEREAS, The City Attorney has given his opinion that
those Charter amendments voted upon February 27, 1973,
which did not receive a majority of votes cast in the
election were not approved under the conditions of the
City Charter.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
City of Tamarac, Florida:
SECTION 1: That the City Council of the City of
Tamarac does not recognize the validity of any action
taken by the "Charter Board" during the period May 18, 1971,
thru February 27, 1973, and furthermore does not recognize
the passage of Charter amendments Numbers 9, 10, 11, 17,
20, 21, 25, 26, 27, 28 and 29, and'
SECTI.ON_.,2: That the City Attorney is hereby authorized
to pursue all remedies at law to effect a final judicial
affirmation of the aforestated facts.
