CITY OF TAMARAC, FLORIDA
RESOLUTION NO. -14 r
A RESOLUTION AWARDING A CONTRACT FOR
FIRE PROTECTION TO SUBDISTRICT S OF
OF THE BROWARD COUNTY FIRE CONTROL
COMMISSION (BAILEY ROAD VOLUNTEER
FIRE DEPARTMENT).
WHEREAS, there has been no formal fire protection
agreement with Subdistrict 8 of the Broward County Fire
Control Commission (Bailey Road Volunteer Fire Department)
since April 14, 1972, and
WHEREAS, fire protection has been provided for the
period of April 15, 1972 to April 14, 1974 by oral agreement,
the terms of which were identical to those contained in contracts
between the City and Subdistrict 10 for the same two year
period, with the exception of the area protected, and
WHEREAS, litigation between the Bailey Road Volunteer
Fire Department and the Broward County Fire Control Commission
which barred the City from entering into written contract with
Bailey Road Volunteer Fire Department has been settled,
thus removing the restrictions against such contracts, and
WHEREAS, the City Council is desirous of entering into
retroactive contracts formalizing the oral agreements for
provision of fire protection services for the two years
April 15, 1972 to April 14, 1973 and April 15, 1973 to
April 14, 1974, and
WHEREAS, the City Council is desirous of entering
into a new agreement in order to insure the continuation
of fire protection for the residents of that part of the
City of Tamarac serviced by said department for the next
ensuing year beginning April 15, 1974, and
WHEREAS, the rates to be charged have been approved
by the voters of the Subdistrict and the Subdistrict is not
permitted to charge the City at lower rates.
