No. 432 1 CITY OF TAMARAC, FLORIDA RESOLUTION NO. �•- rJ A RESOLUTION DIRECTING THE MAYOR, CITY MANAGER AND CITY CLERK TO EXECUTE A COOPERATION AGREEMENT WITH BROWARD COUNTY TO PARTICIPATE IN THE BROWARD COUNTY i'n MMTTMTMV nT'[7T'T nn MVMM DT nf1 V /"DAWM 13Dnr"DAM WHEREAS, the City Council desires to enter into a Cooperation Agreement with Broward County to participate in the Broward County Community Development Block Grant Program, and WHEREAS, the City Council is desirous of executing such a document. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the terms of the Agreement attached hereto as Exhibit (A) and incorporated herein by reference be and they are hereby approved by the City Council of the City of Tamarac. SECTION 2: The Mayor, City Manager and City Clerk are hereby directed to execute said Agreement on behalf of the City of Tamarac. Board of County Commissioners of Froward County intends to make application for its entitled funds and to act as the administrator of the block grant, as stipulated by the U. S. Department of Housing and Urban Development's block grant regulations; and WHEREAS, the U. S. Department of Housing and Urban Development requires.that municipalities and counties partici- pating in such block grant program enter into cooperation agree- ments tc undertake or to assist in the undertaking of essential community development and housi.rig assistance activities;. NOW, THEREFORE in consideration of the premises and mutual covenants here,lna.tteir contained, the parties do hereby cons(..rit and agree a;; follows; 1. Muni ckoal-County Cooperation The City of � ;mzr L1CC�C_ _ agrees to cooperate with Broward County In the undertaking of essential community development and housing assistance activities as set forth in 51,70.200 of the Rules and Regulations of the U. S. Department; of J(ousit,g, and Urba.rk Development, F.R. 40142, pursuant to a Community Development Block Grant Program for Broward County, Florida to be approved by the U. S. Department of Housing and Urban Development. 2. Inclusion of Municipal Population The City of t C-vyxcx-v- (Z- agrees to the inclusion of its population with that of the unincorporated area of Froward County, for the purpose of qualification of Broward County as an "Urban County„ in accordance with the requirements of the "Housing and Community Development Act of 1974," Public Law 9'-")-383. 3. Purpose and intent It is the purpose and intent of this agreement to provide for local citizen participation as well as local govern= mental participation in the planning process for the development of proposals for the prospective inclusion in the Broward County Community Development Block Grant Program to be submitted to the U. S. Department of Housing and Urban Development. To satisfy such Intent it is agreed by the parties hereto that there shall be local citizens committees, a Countywide Citizens Coalition and a Com- munity Development Advisory Council, whose purposes are defined herein. 4. Local Citizens Committee (a) City agrees to establish a local citizens com- mittee consisting of residents of the City, however, no elected. officials, municipal or County employees may be members of said corff.,Attee. The local citizens committee shall formulate a com- munity development proposal for the municipality. The proposal shall. be approved by the governing body of the municipality and - 2 - cubseq uently submitted to the Countywide Citizens Coalition prov.i ded I-erein. (b) County agrees to establish a local citizens com- mittee for each unincorporated area designated by the Board cf Count..y Conir,.i ssi oners as a low or moderate income area. Each County local citizens committee shal.l be comprised of residents of the designated unincorporated area, however, no member may be an elected official, municipal or County employee. The purpose of said County local citizens committee is to formulate a com- munity development proposal for its designated unincorporated area. The propcsal shall be submitted to the Countywide Citizens Coalition. 5. Countywide Citizens Coalition (a) The parties agree that there shall be a Countywide Citizens Coalition to be comprised of: (1) Two members appointed by each municipality, participating in the Broward County Community Development Flock. Grant Program from each participating municipality's local citizens committee, and (2) Two members from each of the County's local citizens committee. (b) 7t is agreed bythe parties hereto that the purpose of the Countywide Citizens Coalition is to review proposals of the municipal local citizens committees as approved by the govern- ing bodies of the municipalities participating in the Broward County Community Development Block Grant Program and the proposals of the local citizens committees of the unincorporated area. (c) Subsequent to the review of the local citizens cornrni.ttee proposals, the Countywide Citizens Coalition shall develop a plan of community development projects for the pro- ::pective inclusion in the Broward County Community Development Elcc)!: Crrant Program. Such plans shall take into consideration the needs and priorities of the incorporated and unincorporated arcns of Lroward County. The plan developed by the Countywide Citizens Coalition shall be submitted to the Community Develop- ment Advisory Council, created herein, the Broward County Office of Community Development Planning and the Board of County Com- missioners. 6. Community Development Advisor Council (a) The pasties hereto agree that there shall. be established a Community Development Advisory Council which shall consist of one (1) member appointed by each municipality partici- pating in the Broward County Community Development Block Grant Program and one (1) member appointed by the County Administrator. (b) The purpose of such Community Development Advisory Council is to formulate a community development plan for submis- sion to the County. Such plan shall take into consideration the needs and priorities of the incorporated and unincorporated areas of the County. 7. Application The County agrees to review the proposals of the County- wide Citizens Coalition and the Community Development Advisory Council for prospective inclusion in the Broward County Community Development Block Grant Program. Upon review of said proposals the County shall prepare an application containing proposed Com- rriunity Development Block Grant projects, as approved by the Board of County Commissioners for submission to and approval by the U. S. Department of Housing and Urban Development. 8. Allocation of Funds Subsequent to the approval of the Broward County Com- munity Development Block grant application by the U. S. Department. ()f ICoi.iti int!; and Urban Development, the County agrees to allocate the funds pursuant to such approved application. 9. Term This agreement shall be for a term of five (5) years. 1.1. Termination The parties hereto may terminate this agreement by giving a written notice thereof to the other party. However, actual terrrdnation shall occur only between the first day of August and the first day of November of such year of termination.
