HomeMy WebLinkAboutCity of Tamarac Resolution R-1975-137Introduced by: Temp. # Proposed by: ')L) 11 -5 o CITY OF TAMARAC, FLORIDA RESOLUTION NO. / ,5-- 13 7 A RESOLUTION CREATING A MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS IN THAT SUBDIVISION KNOWN AS WESTWOOD COMMUNITY V1, SAID SUBDIVISION SITUATE, LYING AND BEING WITHIN THE CORPORATE LIMITS OF THE CITY OF TAMARAC, COUNTY OF BROWARD, FLORIDA; PROVIDING FOR CRITERIA TO BE USED FOR TERMINATION OF THE SAID MORATORIUM PROVID- ING AN EFFECTIVE DATE. WHEREAS, the City Council, City of Tamarac, Florida, upon investigation and inquiry, has determined that flooding conditions within that area known as Westwood Community VI Subdivision, are detrimental to the health, safety and welfare of the citizens residing therein; and WHEREAS, the City Engineer has presented definitive data to the Council indicating that design standards in said subdivision are defective and do not meet the mandates of the ordinances of the City of Tamarac, or the laws of the State of Florida; and WHEREAS, numerous citizens have raised complaints before the City Council, setting forth flooding conditions in the said sub- division, all of which raised substantial questions as the effec- tiveness of the said drainage system; and WHEREAS, based upon engineering data presented to the City Council, the City Council deems the further issuance of building permits would be detrimental to the health, welfare and safety of the residents presently residing in the said subdivision; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF CITY OF TAMARAC, FLORIDA: SECTION 1: That there is hereby established a moratorium on the issuance of building permits in that subdivision known as Westwood Community Vl, said subdivision situate, lying and being in the City of Tamarac, County of Broward, Florida, excepting, however, building permits for purposes of renovation or remodeling of existing structures on an existing homesite shall not be deemed to be included within the said moratorium. SECTION 2: This moratorium shall remain in full force and effect for such period of time as is necessary to correct the design characteristics of the drainage system and its construction in accordance thereto, pursuant to standards established by City Ordinance and State Law, and subject to final approval of as --built drawings and receipt of other relevant data by the City Engineer. SECTION 3: This resolution shall take effect immediately. PASSED, ADOPTED AND APPROVED this Q(a day of /V613`em6ew 1975. ATTEST: 7?
