A RESOLUTION APPROVING THE PLAT OF LAND
SECTION 4 GOLF COURSE (TIMBER RUN)
WHEREAS, a plat has been submitted for approval by the City of Tamarac,
and
WHEREAS, the City Engineer, City Planner, and City Attorney have reviewed:;r
said plat and have made recommendations for approval and acceptance of said
plat to the Planning Commission of the City of Tamarac and said Planning

Commission has reviewed said plat and has made recommendation for approval and
adoption and execution of said plat by the City of Tamarac, and
WHEREAS, the City Fngineer, City Planner, and City Attorney -lave reviewed
said plat and have made recommendation for approval and acceptance of said
plat by the City of Tamarac, and
WHEREAS, the City of Tamarac is now desirous of approving said plat,
together with dedication of roads and canals-fas amended submitted concurrently
herewith.
NOW, THEREFORE, BE RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That upon the recommendation of the Planning Commission, the
City Engineer, City Planner and City Attorney the plat submitted for approval,
together with the dedication of roads and canalwas amended submitted concurrently
herewith, the same being:
LAND SECTION 4 GOLF COURSE (TIMBER RUN)
be and the same is hereby approved.'

I HEREBY CERTIFY THAT I have approved
the form and correctness of the RESOLUTION.
DEDICATION
KNOW ALL MEN BY THESE PRESENTS, that the undersigned,
LEADERSHIP HOUSING, INC., a Delaware corporation, and SIMON
ZUNAMON, as Trustee under provisions of a certain Trust Agreement
dated December 1, 1972, and known as Trust No. 101, the owners of the
lands described upon Exhibit "A" annexed hereto, which consist of canals
and canal rights of way, lying and situated in Broward County, Florida,
do hereby dedicate to the perpetual use of the public such canals and
canal rights of way, reserving to each of the undersigned, their
successors and assigns, as to the lands respectively owned by each of
the undersigned prior to the execution and delivery hereof, the following
rights:
1. The right to remove water from and add water to that certain
lake forming a portion of the lands described upon Exhibit "A", which
lake is described upon Exhibit "B" annexed hereto.
2. The rights of ingress and egress by pedestrian traffic, motor
vehicle traffic and golf cart traffic, and for crossing by utility lines and
mains, irrigation pipes and mains, and drainage pipes and mains over
and across said canals at all locations presently used for any of the
foregoing purposes, including specifically but not limited to the reserva-
tion of the rights enumerated herein in and to the parcels described
in Exhibit "C" annexed hereto, and at all locations at which the
undersigned owning such lands prior to the execution and delivery hereof,
its successors and assigns may in the future desire to cross said canals
and rights of way for an; such purpose. Each of the undersigned, for
the benefit of itself, its successors and assigns, further reserves the
right to construct and maintain such improvements over and across
the portion of the lands described upon Exhibit "A" owned by it prior to
the execution and delivery hereof, as it determines necessary or desirable,

to permit the aforedescribed uses, including the right to construct and
maintain bridges and other means of crossing provided, however, that
in the event any such construction would otherwise prevent the flow of
waters through such canals, culverts shall be installed under such im-
provements, which culverts shall be of sufficient size in accordance with
sound engineering practice, to permit the flow of waters therethrough
in such quantities as will not cause a material impedance of such flow
of waters.
Certification by both the City Engineer of the City of Tamarac
and an engineer licensed to practice in the State of Florida and retained
by the undersigned, their successors or assigns (the developer's engineer),
shall be conclusive evidence of the sufficiency and size of such culverts.
In the event such City Engineer and developer's engineer shall
be unable to agree as to the sufficiency or 'size of such culverts, then the
Broward County Chapter, Florida Professional Engineers Society shall
be asked by the City Engineer and the developer's engineer to name another
engineer licensed to practice in the State of Florida, whose decision as
to the sufficiency and size of such culverts shall be binding upon both parties
hereto, their successors and assigns.
3. The right to complete the excavation of any such canals, and
the right to repair any defects in the initial installation of any culverts or
crossings, as determined necessary or desirable by the undersigned.
The foregoing provisions shall in no way impose any duty or ob-
ligation upon the undersigned, or either of them, their successors or as --
signs, to construct any improvements, or make any excavations or repairs,
or perform any maintenance over or uponthe lands described upon Exhi-
bit "A, " excepting only the specific obligation above set forth, to install
culverts in connection with other improvements which would materially
impede the flow of waters.

KNOW ALL MEN BY THESE PRESENTS that the undersigned,
LEADERSHIP HOUSING, INC., a Delaware corporation, and SIMON
7UNAMON, as Trustee under provisions of a certain Trust Agreement
dated December 1, 1972, and known as Trust No. 101, the owners of the
lands described upon Exhibit "A" annexed hereto, which consist of road
and road rights of way, lying and situated in Broward County, Florida,
do hereby dedicate to the perpetual use of the public such roads and road
rights of way, reserving to each of the undersigned, their successors
and assigns, as to the lands respectively owned by each of the undersigned
prior to the execution and delivery hereof, the right to cross said roads
and road rights of way with utility lines and mains, irrigation pipes and
mains, and drainage canals, pipes and mains at all locations presently
used for any of the foregoing purposes, specifically including but not
limited to the reservation of the above -enumerated rights in and to the
parcels described in Exhibit "B" annexed hereto, and at all locations at
which the undersigned owning such lands prior to the execution and
delivery hereof, its successors and assigns may in the future desire to
cross said roads and road rights of way for any such purpose. The fore-
going reservation however, shall in no way impair or diminish the police
power of the City of Tamarac nor the right of the City to regulate the an-
ticipated activities contemplated therein, so as to prevent traffic hazards
and other conditions which may be detrimental to the health and safety
of the general public. Each of the undersigned, for the benefit of itself,
its successors and assigns, further reserves the right to construct and
maintain such improvements under the portion of lands described upon
Exhibit "A" owned by it prior to the execution and delivery hereof as it
determines necessary or desirable, to permit the aforedescribed uses. x
Provided, however, that in the event any such construction or mainten-
ance damages any existing paving, such damage shall be repaired by the C

tion with the construction or maintenance of other improvements.
