CITY OF TAMARAC, FLORIDA
RESOLUTION NO.
A RESOLUTION DECLARING THE RESULTS OF THE
GENERAL ELECTION REFERENDUM ON AMENDMENT
TO THE CHARTER OF THE CITY OF TAMARAC
WHEREAS, a general election was held on March 4, 1975,
for the purpose of a referendum on Amendments to the Charter
of the City of Tamarac, and
WHEREAS, the City Council has accepted the results of
the Votomatic voting and absentee ballots as certified by the
Election Board.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That pursuant to Florida Statutes, Section 166.031,
the following amendment is declared to have failed:
"SUBSECTION f of SECTION 11, ARTICLE III, POWERS OF THE
CITY, is hereby amended to add thereto a new section (4)
which shall read as follows:
(4) Upon a finding that a landowner_, his agents
or assigns has presented a site plan which if developed
would impose upon the city a burden of.providing recreational
facilities for the inhabitants of said proposed develo ment,
then the City shall Ee uire the dedication of sufficient
land not to exceed the amount of land necessary or desirable
to provide for recreational facilities needed by those
inhabitants or an amount equal to ten per cent of the land
area of said site plan, whichever is the lesser. Or in
the alternative at the cit 's option, the landowner shall
give a sum of money equal to the then market value of said
required amount of land, which funds shall be specifically
earmarked and used only for the purposes of purchasing
recreational land suitably located to service the inhabitants
of said proposed develo ment."
