A RESOLUTION AUTHORIZING THE CITY
ATTORNEY TO DEFEND INDIVIDUAL
POLICE OFFICERS IN THE LITIGATION
CONCERNING THE ALLEGED FALSE ARREST
OF FRANK M. WATKINS AND FRED W. WEIR
WHEREAS, individuals, FRANK M. WATKINS and FRED
W. WEIR, have commenced litigation against the City of
Tamarac, Officers Serges Joseph, George Calhoun and James
Yocky on the basis of alleged false arrests and false
imprisonment of said individuals, and
WHEREAS, the named police officers may be liable
in punitive damages resulting from such litigation, and
WHEREAS, the professional liability insurance
carried by the City specifically excludes protection against
a finding of punitive damages,and
WHEREAS, American Home Assurance Co., Policy No.
PPL271-8077, does not protect the named police officers from
a finding of punitive damages, and
WHEREAS, the City Council of the City of Tamarac,
upon investigation and inquiry, had determined that it would
be in the best interests of the citizenry of the City of
Tamarac to afford legal protection to the named police officers
through the office of the City Attorney,
NOW, THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC,FLORIDA:
SECTION 1: The City Council of the City of Tamarac,
Florida, does hereby authorize the City Attorney to undertake
the defense of Serges Joseph, George Calhoun, and James Yocky
in all matters relating to case nos. 75-1678 and 75-1681 in
the Circuit Court of the Seventeenth Judicial Circuit in and
for Broward County, Florida.
