CITY OF TAMARAC, FLORIDA
RESOLUTION NO. 75-51
A RESOLUTION AMENDING RESOLUTION NO. 75-37
GRANTING A SPECIAL USE EXCEPTION FOR BEER
AND WINE CONSUMPTION TO JOHN PRESTON:
TRANSFERRING THE BENEFITS OF SUCH SPECIAL
USE EXCEPTION TO SEA N' FARM, INC. WITH
CONDITIONS.
WHEREAS, pursuant to the terms and conditions of Ordinance
Number 73-60 of the City of Tamarac the City Council of the City
of Tamarac granted a special use exception for beer and wine
consumption in favor of John Preston by Resolution Number 75-37
and,
WHEREAS, John Preston is the controlling shareholder in
Sea N' Farm, Inc., and
WHEREAS, Sea N' Farm, Inc. is now the proprietor of the
premises in which said special use exception for beer and wine
consumption was granted, and
WHEREAS, John Preston has requested that said special
use exception for beer and wine consumption be transferred to
Sea N' Farm, Inc., and
WHEREAS, the City Council of the City of Tamarac has,
upon investigation and inquiry, determined that the requested
transfer would not jeopardize the health, safety and welfare of
the City of Tamarac, and
WHEREAS, the City Council of the City of Tamarac is
desirous of transferring the benefits of said special use
exception upon certain conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The City Council of the City of Tamarac does
hereby transfer the special exception permit for beer and wine
consumption on the premises from John Preston, sole proprietor,
to Sea N' Farm, Inc. a Florida corporation, subject to the
terms and conditions hereinafter set forth.
SECTION 2: CONDITIONS OF APPROVAL.
(1) The permit is limited to Sea N' Farm, Inc., a Florida
corporation and said special use exception permit shall
not be assigned.
(2) There shall be no take-out of beer or wine.
(3) There shall be no service of beer or wine after the
hour of 11 p.m.
(4) The sale and consumption of beer and wine shall be
accomplished only in conjunction with the service
of food consumed on the premises, and beer or wine
may not be sold without the purchase of food in
conjunction therewith.
(5) The special use exception permit granted to John Preston
pursuant to Resolution Number 75-37 is hereby transferred
to the Sea N' Farm, Inc., a Florida Corporation, and shall
become null and void immediately upon the transfer
by John Preston of his controlling interest in Sea N' Farm,
Inc., whether the said transfer of the control be
accomplished by sale, assignment, gift or other ise.
