A RESOLUTION AUTHORIZING THE EXECUTION OF AN
AMENDMENT TO AGREEMENT NO. 76-6C-06 BETWEEN
THE BROWARD MANPOWER COUNCIL AND THE CITY OF
TAMARAC.
WHEREAS, the Broward Manpower Council and the City of Tamarac
have entered in Agreement No. 76-6C-06 to conduct a CETA Title VI
public service employment program, a.r(l,
WHEREAS, the Broward Manpower Council and the City of Tamarac
desire to amend Agreement No. 76-6C-06 in order to condense the
number of Agreements between the Broward Manpower Council and the
City of Tamarac.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the Mayor and the City Manager are hereby
authorized to enter into and execute or; behalf of the City of Tamarac,
Florida, an amendment to Agreement No. 76-6C-06 in the amount of
$126,945.54 between the City of Tamarac and the Broward Manpower
Council, a copy of which is attach(-:d hereto as "EXHIBIT All.
SECTION 2: That this amendr-,ent to the said agreement shall
become effective immediately and shall in force through the
30th day of June, 1976.

Florida 33311 AND THE City of Tamarac ;
existing under and by virtue of the laws of the State of Florida
as a Municipal Corporation having its principal offices at 5811
.Northwest 88th Avenue, Tamarac, Florida 33321 ,
WITNESSETH THAT:
WHEREAS Agreement No. 2C-12 and Agreement No.6C-06 '
.are due to expire on the 31st day of January 1976, and the 19th i
:,day of January 1976, respectively; AND
' WHEREAS the Broward Manpower Council (hereinafter the
BMC) and the City of Tamarac (hereinafter the Agent) have
::entered into Agreement No.76--6C-06 to conduct a CETA Title VI 1
public service employment program, AND ;

j? WHEREAS the BMC and the Agent desire to transfer the
';positions in Agreement No. 2C-12 and Agreement No.6C-06 to
.the current public service employment program under Agreement No.
76--6C--06 AND
WHEREAS, in an effort to condense the number of Agreements
;between the BMC and the Agent which entails duplicative administra-'
tive and fiscal procedures for both parties; '
NOW THEREFORE, in consideration of the premises and the
.mutual covenants and obligations herein contained, and subject to
'the terms and conditions hereinafter stated, the parties hereto
understand and agree as follows:
1. The terms of Agreement No.76-6C--06 are here incor
porated into this Amendment by reference and all obligations there
under are to continue through the 30Ch day of June 1976, beginning'
on the 1st day of February 1976 as to Agreement No. 2C-12 and
beginning on the 20th day of January 1976 as to Agreement No_ t
6C-06
2. The terms and conditions of Agreement No. 2C--1.2
and Agreement No. 6C--06 are not to be construed as part of this
Amendment.
3. This Amendment contemplates payment for services ren-
li
dered by the Agent based on cost reimbursement by the BMC of ac-
ceptable expenses expended between the 20.th day of January 1976
through the 30th day of June 1976, not to exceed the amount of
$126,945-54 , -ubich has been determined by multiplying the tii^.:rer
of CETA public service employees requested in the Agent's proposals
by the amount of salary and fringe benefits so requested for the
Amendment duration. This amount is in addition to the amount des-
ignated in Budget Summery attached to Agreement No. 76--6C-06 It is
understood aad agreed by the Agent that accrual funds f-o=

4, The Agent is permitted to continue to emp-_v
CETA Title II and CETA Title VI participants who were hir_•.: under
Agreement No. 2C-I2 and Agreement No. 6C--06 ,
subject to Part IT, Article IV (Placement Goals) of the Laid
aid
Agreement.
5. The Agent shall provide the BMC, on a monthly basis,
with proper supporting documentation conforming to the regiLirements
of CETA/BZ,1C, a breakout of the funds already expended under this
Amendment for the previous month. Such financial status reports
will be required within ten (10) working days following the end of
each month.
6. Reimbursement by the BMC shall be made contingent upon
receipt of the monthly financial status report; upon receipt of such
report, the BMC will reimburse the Agent for the expenses stated
therein which are acceptable and allowable. The cumulative amount
paid on any given month shall not exceed the total amount to be
spent in performance of this Amendment.
7. In no case shall salaries and concomitant fringe
benefits be paid in advance of work performed.
8. The BMC reserves the right to adjust the outflow of
funds more or less than originally anticipated up to the amount of,
the Amendment budget.
9. The updated Budget and Occuaptional Summaries are in
addition to the Budget and Occupational Summaries attached to
.Agreement No. 76-6C--06 All other Attachments to Agreement No.
76-6C-06 are incorporated by reference into this Amendment,
IN WITNESS THEREOF, the foregoing have executed the
Amendment as of the date written above.

of sixty (60) ch yrs after -the time of opening of this bid and that the bidder will not
revoke or cancel this bid within the sixty (60) days.
In the event the contract is awarded to this bidder, he will enter into a formal
written Agreement with the City, in accordance with the accepted bid within ten (10)
calendar days after said contract is su'omitted to him and will fucn:isa to the City a
Contract Performance and Payment Bond with good and sufficient sureties, satisfactory
to the City, in the amount of 1000 of the accepted bid, the form and terms of which
shall fully comply with Section 255.05, Florida Statutes. The Bidder agrees that in
the event of the Bidder's default or breach of any of the agreements of this bid, the
said bid deposit shall be forfeited as liquidated damages.
Al! work shall be guaar-azteed by the bidder against defects resulting from the use of
ma.terLals, equipment or t�,o �;nanship for one year from the date of final corrpletion
of the contract.
If, within any given period, repairs or changes are required in connection with the
px-rantee uurk, which in the opinion of the City is rendered necessary as the result
of the materials supplied which are defective, or inferior, or not in accordance with
the terms of the Contract, the bidder shall, promptly upon receipt of notice from the
City and without expense to the City, proceed to: Place in satisfactory condition in
every particular all of such g�_taranteed stark, correct all defects therein.
Fielder to state any additional work,changes, or variations to the City's specifications
terms and conditions.
