A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO NEGOTIATE THE PURCHASE OF INSURANCE POLICIES, COVERING THE PHYSICAL AND PERSONAL PROPERTY OF THE CITY; LIABILITY; WORKMEN'S COMPENSATION FOR THE EMPLOYEES; AND DE- CLARING AN EMERGENCY WHEREAS, many insurance carriers authorized to do business in the State of Florida have experienced serious underwriting problems, resulting in economic conditions which have affected their financial posture to the point that many insurance companies are limiting the extent and amount of insurance coverage to government, persons, and businesses in Florida, and WHEREAS, the insurance carriers are becoming very selective in choosing to whom they issue insurance policies covering certain liabilities, and WHEREAS, the City of Tamarac cannot be considered a good underwriting risk by reason of the Loss factor, and WHEREAS, the City of Tamarac has had its workmen's compensation insurance coverage cancelled and has been unsuc- cessful in finding an insurance company willing to undertake the writing of such coverage for the employees of the City of Tamarac, and WHEREAS, many of the current policies of insurance for the City are soon to expire, with very few insurance companies expressing any interest in writing insurance coverage for the City of Tamarac, and WHEREAS, the financial posture of the City of Tamarac prohibits the City from becoming a self insurer, and 11 1 1 WHEREAS, the Charter of the City of Tamarac, Article VII, Section 40(i) sets forth the authorization for making pur- chases, and Article XVI, Section 109, provides for the procedure, exempting therefrom, purchases to be made when the Council finds that in the event of an emergency (as defined therein) the require- ment of advertising for bids may be dispensed with. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA SECTION 1: The Council finds an emergency exists which is of great concern affecting the safety, health, and welfare of the City by reason of the fact that the City is in jeopardy of being unable to obtain insurance coverage, and it's of dire necessity to have insurance coverage to protect any losses that might be sustained by the City resulting from fire, injury, larceny, accident, or other loss or damages and to dispense with the requirements of Article XVI, Section 109 of the Charter. SECTION 2: The Council finds it necessary, because of the emergency, to provide, by resolution, for the City Manager to negotiate the purchase of insurance policies in order to protect the City.
