'7(0- (,1 A RESOLUTION ADOPTING A LEGAL OPINION OF THE CITY ATTORNEY OF TAMARAC RELATIVE TO CERTAIN REQUIREMENTS PERTAINING TO ORDINANCE 74-31 (IMPACT ANALYSIS); PROVIDING AN EFFECTIVE DATE WHEREAS, the City Attorney was requested to furnish his legal opinion with reference to an interpretation of Ordinance No. 74-31, as to whether or not certain require- ments were permissive or mandatory, and WHEREAS, the City Attorney has been advised that a part of said Ordinance may be administratively interpreted to impose an impossible requirement for obtaining an endorse- ment by the Central and Southern Florida Flood Control District as a condition precedent to approval of a plat or site plan, and WHEREAS, the City Council of the City of Tamarac wishes to adopt the opinion of the City Attorney, dated April 30, 1976, that said requirement is permissive and not man- datory. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the City Council of the City of Tamarac adopt said opinion of the City Attorney and determine that under Ordinance No. 74-31, said endorse- ment by the Central and Southern Florida Flood Control District is informational, and therefore permissive, and not mandatory upon applicants as a prerequisite for consideration of a plat or site plan. SECTION 2: This Resolution shall become effective immediately upon its passage. PASSED, ADOPTED AND APPROVED thisday of ,1976. T ATTEST: t.
