HomeMy WebLinkAboutCity of Tamarac Resolution R-76-103Introduced by : /�' Temp. #S,?0 Proposed by: C,• 14 CITY OF TAMARAC, FLORIDA RESOLUTION # 76 -10 A RESOLUTION VOICING THE CONCERN OF THE CITY COUNCIL OF THE CITY OF TAMARAC OVER THE RATES CHAR® IN THE STATE OF FLORIDA FOR LIABILITY INSURANCE COVERAGE AND STRONGLY URGING THE FLORIDA LEGISLATURE TO TAKE IMMEDIATE ACTION TO REDUCE THE COST FOR LIABILITY INSURANCE IN THE STATE OF FLORIDA AND TO CLARIFY THE IMMUNITY OF MUNICIPALITIES UNDER FLORIDA STATUTE 768.28. PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Tamarac is concerned with the ever increasing rates charged by insurance companies for all types of liability insurance; and WHEREAS, the City of Tamarac is desirous of expressing its concern to the Broward County Legislative Delegation in order to promote and foster attention to and a solution of such problem; and WHEREAS, the City of Tamarac welcomes other municipalities to likewise voice their concern over the problem of rising insurance rates; and WHEREAS, the Attorney General of the State of Florida, in Opinion No. 076-41, dated February 23, 1976, has ruled that, with the exception of immunity in the exercise of legislative, judicial, quasi -legislative and quasi-judicial functions, municipalities possessed no aspect of the State's soveriegn immunity from tort liability upon which the State':s waiver of soveriegn immmity contained in Florida Statute 768.28 and the statutory limitations applicable thereto could operate; and WHEREAS, a clarification by the Florida Legislature that Florida Statute 768.28 is applicable to municipalities in all areas of tort liability will produce substantial and immediate insurance cost savings for all municipalities of Florida and will enable municipal funds to be directed into more critically needed areas; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the City Council of the City of Tamarac does hereby voice its concern with regard to the rates charged in the State of Florida for liability insurance coverage and hereby strongly urges the Florida Legislature to take immediate action to reduce the cost of liability insurance in the State of Florida and to clarify the immunity of municipalities under Florida Statute 768.28. 1 1 SECTION 2: That by copy of this Resolution, other municipalities in Broward County, Florida, be urged to likewise express their support for legislation that will reduce the high cost of insurance in the State of Florida. SECTION 3: That copies of this Resolution be sent to all members of the Broward County Legislative Delegation.
