A RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO ENTER INTO A LEASE AGREEMENT WITH SIMON ZUNAMON, TRUSTEE. WHEREAS, Simon Zunamon has offered to lease to the City of Tamarac certain lands for use as a public recreation area, and WHEREAS, the City of Tamarac wishes to accept the offer made by Simon Zunamon. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the Mayor and City Manager be and they are hereby authorized and directed to enter into a lease agreement copy of which is attached hereto and made a part hereof by reference, for property described as: All that part of a 180 foot wide Florida Power and Light easement lying South of the C-14 Canal and bounded on the West by the Westerly line of Section 6 Township 49 South, Range 41 East, and running from thence to the Easterly boundary of the City of Tamarac SECTION 2: That said lease agreement shall be effective for a period of one (1) year from the date of its execution or until the leased property is dedicated to the City. WEINBERGER — I LEASE THIS AGREEMENT, made this 30th day of June, 1976, between SIMON ZUNAMON, AS TRUSTEE, Tamarac, Florida, herein- after designated the "Landlord" and the CITY OF TAMARAC, a municipal corporation under the laws of the State of Florida, hereinafter designated the "Tenant". W I T N E S S E T H WHEREAS, Landlord is the owner of title in fee simple to certain lands as hereinafter described, and WHEREAS, in consideration of the mutual covenants and agreements herein contained and the payment hereinafter specified, Landlord hereby grants to the Tenant occupancy of the premises set forth below and Tenant hereby accepts such occupancy for the purpose as hereinafter granted subject to the terms and conditions hereinafter set forth with which Tenant agrees to comply. follows: NOW, THEREFORE, the parties hereto do agree as 1. Landlord, in consideration of the covenants herein contained, does hereby lease to the said Tenant the following described property, situate, lying and being in Broward County, Florida, generally described as follows: ALL that part of a 180 foot wide Florida Power and Light Company easement lying South of the C-14 Canal and bounded on the West by the Westerly line of Section 6, Township 49, South range 41F, and running from thence to the Easterly boundary of the City of Tamarac. 2. The term of this lease shall be for a period of one year from the date hereof but shall sooner terminate in the event the leased property is dedicated to the Tenant. During the period of this lease the premises shall be occupied by the City of Tamarac and used for recreational purposes only. 3. For and in consideration of this lease, Tenant shall pay the Landlord the sum of One Dollar ($1.00) per year, and in addition, the Tenant shall pay all ad valorem taxes and special assessments imposed against the leased premises. Such taxes and assessments shall be pro -rated as of the commencement and termination of this lease. 4. During the occupancy of the premises by the Tenant, the Tenant shall be allowed to make appropriate modifications of the land so that the same may be effectively used as a recreational area for the residents of the City of Tamarac. 5. The Tenant agrees to maintain personal injury and property damages liability insurance covering the premises leased herein in the amount carried generally by the City for all other City properties with Landlord na«ed as an insured party, and Tenant further agrees to hold Landlord harmless and indemnify Landlord from any loss, cost, or expense sustained or incurred by Landlord by reason of any damage or injury to the person or property of any person. 6. Landlord agrees that the land described herein is subject to an easement in favor of Florida Power and Light Company and may not be used for any purposes inconsistent therewith. 7.
