CITY OF TAMARAC, FLORIDA
RESOLUTION NO. 76-119
A RESOLUTION AUTHORIZING APPROPRIATE
CITY OFFICIALS TO EXECUTE A CONTRACT
WITH THE CITY OF LAUDERHILL FOR THE
CARE AND HOUSING OF PRISONERS.
WHEREAS, the City of Lauderhill and the City of Tamarac
are in agreement to execute a contract to provide for the care
and housing of prisoners of this Municipality by the City of
Lauderhill.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the appropriate City Officials be and
the same are hereby authorized and instructed to execute a
contract with the City of Lauderhill regarding the care and
housing of prisoners of this Municipality by the City of
Lauderhill at the City of Lauderhill Jail. A copy of this
Contract is attached hereto and made part hereof as if set
forth in full herein.

C O N T R A C T
THIS AGREEMENT made this 12 day of October ,1976,
by and between MAYOR EUGENE CIPOLLONI, MAYOR OF THE CITY OF
LAUDERHILL, BROWARD COUNTY, FLORIDA, hereinafter called the
"MAYOR" and CITY OF TAMARAC, a Municipal Corporation of the
State of Florida, hereinafter called "MUNICIPALITY", in considera-
tion of the mutual covenants and agreements between the parties
hereto.
W I T N E S S E T H:
1. The terms of this initial Agreement shall be for
one (1) six month period ending April 12, 1977
and may at the expiration of this term and at the expiration.
of each annual period thereafter be extended for an additional
period of one (1) year, at the option of the MAYOR and at such
terms as he shall set forth.
2. The MAYOR hereby covenants to provide food and
lodging, and other services necessary to the safe keeping, care
and subsistence of persons held in the Lauderhill Municipal Jail
under authority of the Municipality, is to be at the rate of
Eight Dollars ($8.00) per day per inmate, to be paid on a
monthly basis.
3. It is understood by the Municipality that the City
of Lauderhill will accept no delegation of responsibility by
virtue of this Contract in addition to that of providing food
and lodging. Any responsibility beyond these specific provi-
sions remains that of Municipality.
4. It is further understood that Municipality shall be
responsible for all additional expenses incurred in connection
with the safe keeping, care and subsistence of persons held in
the Lauderhill Municipal Jail for and under authority of
Municipality, including but not limited to expenses for medical
treatment, hospitalization, surgery, dental expenses and trans-
portation, except for those injuries that are a direct result of
any accident occuring while said prisoner is housed in the
Lauderhill Municipal Jail. -

5. It is further understood by Municipality that the
necessity for the aforesaid medical treatment will be determined
by the Police Chief of the City of Lauderhill and/or consulting
doctors or hospitals. The Police Chief of the City of Lauderhill
will be under no obligation to obtain the advice and/or consent
of the Municipality for purposes of referral of Municipal prisoners
to proper facilities for medical care and attention, at the expense
of Municipality as aforesaid.
6. The number of prisoners from the Municipality to be
housed in the City of Lauderhill Jail shall at all times be
determined and approved by the Chief of Police of the City of
Lauderhill and the decision as to whether or not such prisoners
may be kept in the Municipal Jail without interference with the
keeping of City of Lauderhill prisoners or in the normal opera-
tion of the Jail shall be the sole and exclusive decision of the
Chief of Police of the City of Lauderhill. The Municipality
shall furnish at all times to the Lauderhill Police Department
a copy of the arrest sheet of any prisoner sent to the Lauderhill
Municipal Jail for incarceration.
7. It is also understood that the City of Tamarac may
use the Lauderhill Court Room facilities for arraignments,
providing that a time is set so as not to interfere with any
functions of the Lauderhill Court.
8. This Contract shall remain in effect in accordance
with the terms provided herein. The MAYOR, may, however, cancel
this Contract upon thirty (30) days notice if in the opinion of
the MAYOR and his CHIEF OF POLICE, the City of Lauderhill's
Jail facilities shall become inadequate to handle prisoners
from Municipalities or in the event of any violation of this
Contract on the part of the Municipality.
9. This Agreement shall not become effective until
it has been accepted and approved by the parties hereto.
