RESOLUTION NO. 76-134
A RESOLUTION PERMITTING SPARER, S. AND SALLY'S PROPERTY
LOCATED APPROXIMATELY TWO HUNDRED FIFTY-THREE FEET (253')
WEST OF UNIVERSITY DRIVE AND NORTHWEST 571H STREET AND
COMMERCIAL BOULEVARD TO ALLOW SUBSEQUENT DEVELOPMENT
APPLICATION SETBACK REQUIREMENTS TO BE MEASURED ALONG
THE EXISTING SOUTH PROPERTY LINE; ALLOWING THE CONSTRUCTION
OF ADVERTISING SIGN NOT TO EXCEED THIRTY-TWO SQUARE FEET;
PREDICATED UPON THE RECEIPT OF A DULY EXECUTED EASEMENT
CONVEYING TO THE CITY OF TAMARAC THE REQUIRED SEVEN (7)
FEET RIGHT -OF- WAY.
WHEREAS, the City Council of the City of Tamarac has requested the
dedication of the necessary right-of-way for Western Commercial Boulevard
along the south property line belonging to Sparer, S. and Sally, described
in the easement annexed hereto as Exhibit "All, and
WHEREAS, Sparer, S. and Sally is willing to donate said property
to the City of Tamarac solely upon the conditions listed hereunder, and
WHEREAS, the City Council has determined that it is in the best
interest of the City of Tamarac to grant Sparer, S. and Sally their request
in order to receive the required seven (7) foot right-of-way donation.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That upon the recommendation of the City Planner and
the City Attorney, the following terms and conditions are hereby resolved:
A) Since Sparer, S. and Sally is donating the land for the
right-of-way in the form of an easement, the original south property line
located fifty-three feet (53') from the centerline of Western Commercial
Boulevard shall remain as the base line for calculating future building set-
backs.
B) Pursuant to the City of Tamarac's sign ordinance 75-43,
Section 15, Waivers: Exception: the City Council of Tamarac recognizes, Sparer,
S. and Sally's request and does hereby grant a waiver to construct an advertising
sign located on their property with a maximum area of 4' x 8' (32 square feet).
SECTION 2: This reoslution becomes effective upon receipt of a duly
executed easement to the City of Tamarac conveying the required seven (7)
foot right-of-way and recordation of said easement at the Recording Division
of Broward County.
