WHEREAS, Resolution No. 76-140 declares that municipal code work is a professional service; therefore, contracts for, such work may be entered into without public competitive bidding; and WHEREAS, the City Council declares the need for a supplement to the current City Code be prepared; and WHEREAS, the City has fully investigated those corporations which do municipal code work and has determined that Municipal Code Corporation of Tallahassee should be designated to prepare the supplement for the Tamarac City Code. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the Mayor and City Manager be and they are hereby authorized and instructed to execute a contract with Municipal Code Corporation of Tallahassee, a copy of which is attached hereto and made a part hereof by reference as EXHIBIT "A" SECTION 2: That this Resolution becomes effective immediately upon its passage. WEINBERGE� R 1 1 1 CONTRACT for the LOOSELEAF SUPPLE14ENT SERVICE for the CODE OF THE CITY OF TAMARAC, FLORIDA by the 14UNICIPAL CODE CORPORATION Tallahassee, Florida 1 ®i 1 This agreement, made and entered into this / S T' day of 77 . 19'%�, by and between the MUNICIPAL CODE CORPORATION, a corporation duly organized and existing under the laws of the State of Florida, hereinafter referred to as the Corporation and the CITY OF TAMARAC, a municipal corporation in the State of Florida, hereinafter referred to as the municipality. WITNESSETH: That upon the terms and conditions set forth in this contract, the Corporation and the municipality hereby agree as follows: (1) SCHEDULE. The Corporation agrees to maintain the Code of the municipality up-to-date by the publication of Loose- leaf Supplements containing the new ordinances of a general and permanent nature enacted by the governing body. The Supplements can be published monthly, bimonthly, quarterly, semiannually or annually, depending on the requirements of the municipality. There is no additional charge for more frequent publication._ A minimum of thirty (30) to forty-five (45) working days shall be required for delivery of a Supplement, following publication of the previous Supplement. (2) ORDINANCES TO BE FURNISHED BY MUNICIPALITY. It is requested that the ordinances be forwarded to the Corporation promptly following enactment by the municipality for recording 'and processing. (3) EDITORIAL SCRUTINY. The new ordinances will be istudied by a member of the law editorial staff of the Corporation jin conjunction with the existing provisions of the Code for the purpose of determining if any provisions of the basic Code fare repealed, amended or superseded. The page or pages of the VCode containing provisions that are repealed or amended by ordi- nance shall be reprinted or printed to remove such repealed or amended provisions and to insert the new ordinances. 1 1 (4) EDITORIAL NOTES. Appropriate editorial notes will be prepared and appended to the new sections as deemed necessary by the Corporation. (5) COtiPARATIVE TABLE AND TABLE OF CO7TENTS. The Corporation will prepare a Comparative Table listing the ordi- nances included in each Supplement and setting out the location thereof. This Table will be inserted preceding the Index. The Table of Contents will also be kept current to reflect changes in the Code volume. (6) INDEX. The Corporation offers to prepare editorially a complete new Index for the entire Code after preparation of the first Supplement published under this agreement. The cost for preparing a new Index will be at the rate specified in Paragraph (8) for other pages to be printed and added to said Code. When the inclusion of new material necessitates changes in the Index in future Supplements, appropriate entries will be prepared and pages of the Index will be printed or reprinted to include the new entries. If a new Index is not desired, the Corporation will prepare a "Supplemental Index," if feasible, and maintain same as ordinances are included in future Supplements. (7) INSTRUCTION SHEET. Each Supplement will contain a page of instructions for removal of the obsolete pages and ,insertion of the new pages. (8) COSTS. The Corporation will prepare the ordinances editorially and print one hundred (100) copies of each Supple-- Iment for the sum of FOURTEEN DOLLARS ($14.00) per page, including blank pages. The maximum for the first Supplement published under this contract shall not exceed FIVE THOUSAND DOLLARS ($5,000.00) or four hundred (400) pages, unless specifically authorized by I the City. For the purpose of this agreement, a page is -hereby defined as the area on one (1) side of a sheet of paper. A sheet contains two (2) pages. �; ,... 3 I 1 1 (9) TABULAR MATTER. The costs provided in Paragraph (8) above are based on a page containing type for ordinary composition. Should the Supplement contain tables, drawings and the like for which other methods of reproduction are required, the cost of such engravings or tabular matter will be additional to the costs as provided above. (10) FREIGHT CHARGES. The Supplements will be shipped to the municipality, for distribution to the holders of the Codes. The shipment will be prepaid and invoiced at the time: of final billing. The municipality shall have the exclusive right to sell and distribute the Supplements. (11) PAYMENT. All money due the Corporation for the publication of the Looseleaf Supplements will be due and payable within thirty (30) days after the date the municipality is invoiced for the same by the Corporation, without interest. (12) TERMINATION.
