RESOLUTION AUTHORIZING THE RELEASE OF AN IRREVOCABLE
LETTER OF CREDIT POSTED BY CASA DE BAMBINI/RICHARD
DOWSETT, FEBRUARY 20, 1975, AND CANCELLATION AND
WITHDRAWAL OF SITE PLAN KNOWN AS CASA DE BAMBINI.
WHEREAS, on February 20, 1975, an irrevocable letter of credit was
posted by Casa de Bambini/Richard Dowsett in the amount of $18,081.25
covering subdivision improvements, inspections and permit fees, and
WHEREAS, Casa de Bambini/Richard Dowsett has requested immediate
release of the irrevocable letter of credit, and
WHEREAS, due to certain problems that have occurred since the
processing and approval of the site plan by City Council on February 20, 1975,
Casa de Bambini/Richard Dowsett has determined that he is not interested in
proceeding with the improvements as contained on the site plan and requests
said site plan be cancelled and withdrawn, and
WHEREAS, the City of Tamarac, upon the recommendation of the City
Engineer, desiring to cooperate with Richard Dowsett, agrees to cancel said
site plan known as Casa de Bambini, together with the release of the irrevo-
cable letter of credit dated February 20, 1975, in the amount of $18,081.25.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the irrevocable letter of credit dated February 20, 1975,
in the amount of $18,081.25 and the site plan known as Casa de Bambini, be and
the same are hereby released and cancelled, subject to receipt by the City
Clerk of a letter from Casa de Bambini/Richard Dowsett, in a form approved by
the City Attorney, releasing the City of Tamarac from any obligation or
liability incurred by the cancellation of the proposed site plan from which
subdivision improvements were determined.

Re: Release of Irrevocable letter of
Credit in the amount of $18,081.25
Dated February 20, 1975, Issued by
the Sun Bank of Wilton Manors, N.A.
Dear Mr. Freel:
This is to request you to submit to the City Council
of the City of Tamarac your recommendation for immediate release
of the irrevocable letter of credit for Project #1113-73, covering
subdivision improvements, inspections and permit fees.
Due to certain problems that have occurred since the
processing and approval of our site plan by City Council on
February 28, 1975, I have determined I am not interested in
proceeding with the improvements as contained on the site plan
and would request said site plan be withdrawn and cancelled.
The undersigned does hereby release the City of Tamarac
from any obligation or liability incurred by the cancellation of
the proposed site plan from which the subdivision improvements
were determined, together with any right, claim or demand for
any fees paid to the City of Tamarac by the undersigned relating
to the processing of the site plan.
Further, the undersigned hereby relinquishes any rights
or interests that might have vested with the approval of the site
plan since I acknowledge that there may be a substantial change
in the requirements for site plan approval and building approvals
in the future.
