RESOLUTION NO. 76-96
A RESOLUTION COMMITTING THE CITY OF
TAMARAC TO WAIVE FUTURE PUBLIC IMPROVE-
MENTS ALONG THE SOUTH PROPERTY LINE FOR
THE PREMISES LOCATED AT 7030 NW 57TH
STREET, TAMARAC; ALLOWING SUBSEQUENT
DEVELOPMENT APPLICATIONS SETBACK REQUIRE-
MENTS TO BE MEASURED ALONG THE EXISTING
SOUTH PROPERTY LINE; PREDICATED UPON THE
RECEIPT OF A DULY EXECUTED WARRANTY DEED
CONVEYING TO THE CITY OF TAMARAC THE
REQUIRED SEVEN (7) FEET RIGHT-OF-WAY.
WHEREAS, the City Council of the City of Tamarac,
has requested the dedication of the necessary right-of-way for
Western Commercial Boulevard along Dr. Meador's, Jr., D.D.S.
south property line as described in the Warranty Deed annexed
hereto as Exhibit "A", and
WHEREAS, Dr. Meador, Jr., D.D.S. is willing to
donate said property to the City of Tamarac solely upon the
conditions listed hereunder, and
WHEREAS, the City Council has determined that it is
in the best interest of the City of Tamarac to grant Dr. Meador's
Jr., D.D.S. request in order to receive the required seven (7)
foot right-of-way donation.
NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That upon the recommendation of the
City Planner and City Attorney, the following terms and con-
ditions are hereby resolved.
A. The City Council hereby declares
that it will not cause to levy, impose or assess by special
assessment the following public improvements south of the new

property line adjacent to Western Commercial Boulevard:
1) Sidewalks
2) Curb and gutters
3) Landscaping.
B. Pursuant to the letter annexed
hereto designated as Exhibit "B", Broward County has agreed
to pave the ingress and egress driveways from Dr. Meador's Jr.,
D.D.S. property to the new Western Commercial Boulevard north
pavement line.
C. The setback requirements along
Commercial Boulevard will be measured from the existing south
property line for all future development applications.
SECTION 2: This resolution becomes effective
upon receipt of a duly executed warranty deed to City of
Tamarac conveying the required seven (7) foot right-of-way.

Re: Acquisition Of right-of-way and median openings for
Commercial Boulevard.
In response to your letter dated April 12, 1976, and after thorough consider-
issues
ation Of these problems, it is apparent that we can rectify some of the
mentioned.
Wherever possible on our final design of Commercial Boulevard, we will install
storage and median openings so as to conform with a 660 foot spacing. In the
areas where this spacing isn;t appropriate, the spacing will be greater, but
not less
than 660 feet. This in itself will alleviate the problems for
Lindsley Lumber (Block 4,*.Lyons Commercial Subdivision).
In my past conversation with Jack CuLrmings (Trustee for -Block 6, Lyons Com-
mercial subdivision) we -have discussed the tweV.'possibilities for median
openings in the area of Block 6 and 7 The;first;possibility is to allow median
openings only at -intersections where.the:sidestreets are. dedicated right of -way, -
in the cases of Northwest 79 Avenue, -Northwest..82 Avenue and : Northwest°$4 -`
Terrace. The second is to allow an,openng_�at Northwest ?9 Avenue,` one at North
west 84 Terrace, one 660 foot east from Northwest 84 Terrace,;`and one 660 foot,
west from Northwest..79 Avenue. ,This'I hope will satisfy 'both_you and Mz Cum
