A RESOLUTION URGING THE CABINET OF THE STATE OF FLORIDA TO ADOPT THE LITITE FTC ACT RULES PROMULGATED BY THE DEPARTS OF -6 AL AFFAIRS OF THE STATE OF FLORIDA WITH RESPECT TO TIE- IN SALES ON RECREATION LEASES AND PROVIDING FOR DISTRIBUTION OF SUCH RESOLUTION, WHEREAS, the Attorney General of the State of Florida, acting on behalf of the Department of Legal Affairs, has promulgated certain rules pursuant to the Little FTC Act relating to tie-in sales of recreation leases, and WHEREAS, the Attorney General, after numerous hearings and investi- gations , has concluded that in many instances developers of housing units have conditioned the sale of housing upon the buyer's acceptance of the developer's recreational lease or contract, and UHMEArS , in many instances consumers have been paying unconscionable fees for recreational services which precluded such consumers from obtaining competitive -recreational services at a mach lower price, and WHEREAS, the Attorney General has concluded that the protection of the consumers requires that the enforcing authority for the State and consumers, individually or by class action, should be given the authority to overturn such recreational leases which are found.to restrain trade, and the Attorney General has also found that the abuses resulting from such recreational leases and contracts are so wide -spread as to affect large nunbers of the public, and WIEREAS, the City Council of the City of Tamarac has concluded that large numbers of such consumers exist in this City so as to create an issue affecting the public generally, and WHEREAS, the said City Council believes that the adoption of the rules promulgated by the Attorney General will resolve within a reasonable time, the problems created by the wide -spread existence of such recreational leases and contracts. FLORIDA: NOW; THEREFORE , BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TMARAC , SECTION 1: That the Cabinet of the State of Florida. is hereby urged to immediately adopt the Little FTC Act rules on Tie -In Sales of Recreation Leases and that this action on the part of the Cabinet is necessary since the continued existence of such recreational leases and contracts will have a serious inpact on the economy of the residents of this City resulting in an adverse affect on the welfare of such residents. SECTION 2: That copies of this resolution be sent to the Governor and to all other members of the Cabinet of the State of Florida.. -- SECTION 3: That the Council shall distribute copies of this resolu- tion to the Viers of the Federal Trade Coamission together with other relevant material so that such Commission may take appropriate action pursuant to the Federal laws in existence against the restraint of trade.
