CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R - 77-c�
A RESOLUTION ACCEPTING A RECREATION FEE OF $12,900*00
TO THE PARK AND RECREATION FUND FROM HLR, INC. AND
RELEASING HLR, INC. FROM RESPONSIBILITY TO CONSTRUCT
RECREATION FACILITIES AT COLONY WEST ESTATES.
WHEREAS, HLR, INC., the owner and developer of the subdivision
platted as Colony West Estates and also known as Westchester, has
determined that construction of recreation facilities within the
subdivision would not serve the best interests of future lot
owners of the area, and
WHEREAS, HLR, Inc., has petitioned the City Council to allow
them to remit monies to the City's Park and Recreation Fund in
lieu of constructing said recreation facilities, and
WHEREAS, the City has determined that pursuant to its
Ordinances a total payment to the Park and Recreation Fund of
$12 , 9 0 0.0 0 would be required from the developer, if recreation
facilities are not constructed,
WHEREAS, in October 1976,
and
the City received a partial payment
in the amount of $ 6 , 9 0 0.0 0 for a portion of the land which was
determined
to be
unsuitable for development as
a recreation area
due to its
shape,
and a subsequent check for $6,000.00,
has been
remitted to the City to cover the balance, and
WHEREAS, the City Council desires to acknowledge the payment
in full to its Park and Recreation Fund, and release HLR, Inc.
from its original responsibility to construct recreation facilities
within the Colony West Estates development.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION
1:
The
City
Council
hereby acknowledges
receipt from
HLR, INC., of
$12,900.00,
being the
payment due to the
City Park
and Recreation Fund, required pursuant to City Ordinances,
project, platted as Colony West Estates, and also known as
Westchester.

SECTION 2: HLR, INC. is hereby released from its original
responsibility to construct recreation facilities in the Colony
West Estates development.
