A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TAMARAC IN OPPOSITION TO THE
IMPLEMENTATION OF THE B ROWARD COUNTY
LAND USE PLAN
WHEREAS, with the adoption of the Charter for
Broward County, specifically under Section 8.04., County
ordinances prevail over municipal ordinances in the area of
land use planning; and
WHEREAS, the City Council of the City of Tamarac
acknowledges the authority as set forth in said charter in
the area of land use planning; and
WHEREAS, the City Council of the City of Tamarac
takes public notice of the efforts by the County to adopt
a county -wide land use plan; and
WHEREAS, the City Council of the City of Tamarac
has cooperated with the County in submitting a.municipal land
use plan to the County for integration with the County plan;
and
WHEREAS, the City Council has been apprised of
legislation to be adopted by the County concerning the
implementation of the County's land use plan; and
WHEREAS, the City Council of the City of Tamarac
has reviewed said legislation which purports to implement the
County plan and believes that said legislation seriously dis-
torts the intended relationships between the County and muni-
cipal government pursuant to Section 8.04 of the County charter,
in that if said legislation is adopted, the County shall have

absolute control over all City functions related to growth
and including the functions presently maintained by municipal
planning and building departments; and
WHEREAS, the City Council of the City of Tamarac
believes that the intention of the County charter is not to
destroy an effective role by municipal governments in the'
planning, zoning and/or building department areas; and
WHEREAS, the City Council of the City of Tamarac
believes therefore that the proposed legislation to implement
` the Broward County land, use plan should be defeated and a redraft
should be presented with a view towards the implementation of
the County charter as adopted.
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC , FLORIDA:
SECTION 1: That the City Council hereby formally
opposes the adoption of the proposed legislation implementing
the County land use plan in that said legislation is wholely
inconsistent with the State Home Rule Law and with the intention -
of the County charter as adopted
and as approved by all the citizens of Broward .County; in that
said legislation, if approved, would effectively destroy muni-
cipal government as an effective tool in the future growth of the City
and County as it relates to planning, zoning and/or building
development.
