Temp. # 3/11/77 131 CITY OF TAMARACI FLORIDA RESOLUTION NO. - 7 RESOLUTION COMMITTING THE CITY OF TAMARAC TO WAIVE THE PLATTING REQUIREMENTS FOR THE EXISTING STRUCTURES AND VEHICULAR PARKING AND CIRCULATION AREA ON PREMISES PRESENTLY KNOWN AS "GRANT'S PLAZA SHOPPING CENTER", LOCATED AT THE NORTHWESTERLY INTERSECTION OF COMMERCIAL BOULEVARD AND U.S. HIGHWAY NO, 4 41 ( STATE ROAD 7 ) , UPON THE RECEIPT OF A DULY EXECUTED QUIT -CLAIM DEED CONVEYING TO BROWARD COUNTY A 7' RIGHT-OF-WAY FOR THE WIDENING OF COMMERCIAL BOULEVARD ADJOINING SUCH PROPERTY, AND APPROVI14G A SITE PLAN FOR SUCH PROPERTY AND PERMITTING THE INSTALLATION OF DIRECTORY SIGNS UPON SUCH PROPERTY* WHEREAS, the City Council of the City of Tamarac has requested the dedication to Broward County of the necessary 7-foot right- of-way for Western Commercial Boulevard, along and adjacent to that certain property. known as the Grant's Plaza Shopping Center, owned by UMET Trust and leased to Summit Properties, an Ohio Business Trust, which property is more particularly described on Exhibit "A" hereto annexed; and WHEREAS, UMET Trust and Summit Properties are willing to convey said property to Broward County, upon the request of the City Council of the City -of Tamarac, solely upon the conditions set forth hereunder; and WHEREAS, the City Council of the City of Tamarac has determined that it is in the best interests of the City of Tamarac to authorize the conditions listed hereunder, which conditions the City Council is empowered to authorize*. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That upon the recommendation of the City Planner and City Attorney, the following terms and conditions are hereby resolved and adopted: A. That the contents of that certain Site Plan sub- mitted by Summit Properties and prepared by Craven, Thompson & Associates, Inc., dated September 20, on March 23 , 1977, (as amended) Revised Parking and Circulation Plan, 1976, and last revised entitled "Summit Properties Plaza Tamarac, Florida", hereinafter referred to as the "Site Plan"), is approved, and the same is adopted as the Site Plan for said shopping center located upon the property described on Exhibit "A" annexed hereto. B. That the landscaping shown on said Site Plan is approved and accepted. C. That the two shopping center signs identifying the shopping center and containing tenants' directories, as located upon the Site Plan, and as shown by those certain drawings for such signs, prepared by MELWEB SIGNS, INC./ELECTRO DIVISION, under said Company's Drawing No. 677109-II, dated January 18, 1977 and revised on February 18, 1977, and Drawing No. 677210, dated February 10, 1977, are hereby approved and authorized, and that a waiver is hereby granted by the City of Tamarac from City of Tamarac's Sign Ordinance No. 75-43, to the extent that the erection of such signs may be inconsistent with such Ordinance. (See sign exhibits C and D as amended 3/23/77). D. That the requirement of Platting, as provided in Chapter 20 of the Code of the City of Tamarac or as elsewhere provided, with respect to the property described on Exhibit "A" annexed hereto, is hereby waived and excepted and no platting shall be required of said property only for the construction and remodeling as per Exhibits A, B, C and D, so long as there is compliance with the Site Plan; and no Building Permit shall be denied with respect to the existing structures, parking and vehi- cular circulation on the property, based upon the lack of such platting. E. That no special improvement tax, lien or assessment shall be levied against the property described on Exhibit "A" attached hereto, or any part thereof, in connection with the construction of Western Commercial Boulevard, adjacent to the subject property. F. This Resolution is passed in consideration of and as aninducement. to UMET Trust and Summit Properties to deliver to the City of Tamarac that certain Quit -Claim Deed in favor -of, and acceptable to, Broward County, Board of County Commissioners, conveying a 7-foot right-of-way in the form attached hereto as - 2 - M LI .Exhibit "B" (and conveying the property described in such Exhibit "B" to Broward County for such road right-of-way purposes),, and is intended to be fully enforceable, binding and irrevocable in consideration thereof. It is the intent of the City Council of the City of Tamarac. that although this Resolution has been passed and adopted on the date hereinbelow set forth, it shall not be effective until the delivery of said Quit -Claim Deed, and the recording of same among the Public Records of Broward County, Florida. .G. Prior to granting any building permits which may be requested prior to completion of the Site Plan work, a performance bond in the sum of 125% of estimated costs as approved by the City Engineer in favor of the City of Tamarac shall be provided to assure completion of all work indicated on revised. Site Plan with revision date of 3/21/77 as modified by Council motion. The Principal obligor under such bond shall be Summit Properties. The Surety shall be cash. The City of Tamarac shall be the obligee. Provision shall be made to disburse the proceeds thereof to Summit Properties in stages as the work progresses, to be released in three (3) increments based on itemized costs as work progresses, with a 25% retainage by the City until all work is completed and approved by the City Engineer and subject to approval by the City Council.
