RESOLUTION NO . ) -77-61/
A RESOLUTION ACCEPTING A COVENANT ON PARCELS
B AND C , ` MAINLANDS OF TAMARAC LAKES, NINTH
SECTION, FROM TAMARAC PLAZA ASSOCIATES AND
LEO MARK, AND EXPRESSING AGREEMENT WITH THE
CONDITIONS STIPULATED THEREIN.
WHEREAS, Tamarac Plaza Associates and Leo Mark have executed
and submitted to
the City of
Tamarac
a covenant on
Parcels B
& C
of Mainlands of
Tamarac Lakes,
Ninth
Section, for
acceptance,
agree-
ment and recordation, and
WHEREAS, the conditions of said covenant have been reviewed
by the City Council and Council desires to agree to the conditions
stipulated therein and instruct
the City Clerk to record the
covenant along with a certified copy of this resolution in the
Public Records of Broward County,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC , FLORIDA:
SECTION 1: That the covenant on Parcels B & C , Mainlands
of Tamarac Lakes, Ninth Section, executed by Tamarac Plaza Associates
and Leo Mark, which is attached hereto and made a part hereof by
reference, is hereby accepted.
SECTION 2: That the Council hereby agrees to the conditions
of said covenant.
SECTION 3: That the City Clerk is hereby instructed to
enter the covenant along with a certified copy of this resolution -
in the Public Records of Broward County.
PASSED, ADOPTED AND APPROVED this 3 day of 1977.

COVENANT
WHEREAS the undersigned herebycertify that the are now the Owners of
fY y Parcels
"B" and "C" of the MAINLANDS OF. TAMARAC LAKES NINTH SECTION as
recorded in Plat Book 76 at Page 48, Broward Count records said Parcels
- Y ,
being located in the City of Tamarac, 8roward County, Florida, and
WHEREAS said Owners desire to construct.a building on said Parcel "Cwhich
building will encroach into the existing set -back on Parcel"C" adjacent to Parcel "B"
by virtue of existing, legal zoning regulating such set --backs in existing zoning
THIS COVENANT is herebyentered into b and between said Owners and the City Y
of Tamarac, Broward County, Flcr ida, to wit:
Y 1. IN LIEU of securing a variance for said set -back encroachment of
1'-8" in the sou therly set --back area of Parcel "C", the Owners
agree that both said Parcels are and shall remain under one owner-
ship and that the sale of one Parcel shall include the sale of the other
Parcel. This Covenant shall be in perpetuity Yer etuit and shall run with the
land.
2, If a variance is secured b the then Owners of said Parcels such

variance allowing and authorizing the encroachment of the 1'-8"
in the southerly set -back area of Parcel "C", the City Council of the
City of Tamarac does hereby agree to the release of this Covenan .
