A RESOLUTION AUTHORIZING THE ASSISTANT CITY
ATTORNEY TO EXECUTE A STIPULATED SETTLEMENT
BETWEEN THE CITY OF TAMARAC AND W.J. OROVITZ
AND B. HAIMAN, TRUSTEES.
WHEREAS, the City of Tamarac has entered into negotiations
to settle
litigation
between Warren
James Orovitz and Barry
Haiman, as
trustees,
plaintiffs and
the City of�Tamarac, defendents, and
WHEREAS, both parties have agreed to certain conditions included
in the proposed stip.plated settlement, and
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION.1: That the Assistant City Attorney is hereby
authorized to execute a stipulated settlement of the litigation
between
Warren James
Orovitz and Barry
Haiman, trustees and
the
City of
Tamarac, Case
No. 75-19999, in
the Circuit Court of
the
17th Judicial Circuit, in and for Broward County, Florida, a copy
of which settlement is attached hereto as "Exhibit A".

The parties hereto, -by and through their undersigned counsel,

stipulate and agree as follows
11 The Defendants shall dismiss, with preju,dice, their
appeal presently pending in the captioned case.
20 The Defendants shall comply with the Circuit Court Is
Final: Judgment in the captioned cause, as amended by the Court's
Order of. December 16, 1976., except with regard to the western
thirty (301) feet of the subject property, and the Final Judgment
shall be amended to delete said western thirty (301) feet from
the force and effect of said Final Judgment. The western thirty
(301) feet shall be measured from the western boundary of the
subject property, said boundary being the eastern edge of the
existing canal .
3. The Plaintiffs, their heirs, successors or.assigns
(.the "Owners".) will apply to rezone -the western thirty (301)
feet to the Zoning category- of S-1 (hereinafter the S-1 Property) ,
subject to the following conditions:
('.a The Owners will not be required to build a seawall

along the boundary of the S-1 Property.

b The Owners will execute a covenant restricting,
in the --use of the S-1 Property to open space
perpetuity,
(c) The Owners shall perform the following with regard r
to the S --1 Property
(i)Slope the canal bank according to
applicable CITY of TAMARAC (the "City") ordinances
(ii) Plant healthy eight -foot trees at
twenty-five foot intervals along the canal

bank. The trees shall be either black olive,
mahogany or bis.hofia.
(iii) Commence the sloping of the canal
bank and the planting of the trees within
six months of the execution of the Settle-
ment Agreement
