OROVITZ AND B. HAIMAN, TRUSTEES. WHEREAS, the City of Tamarac has entered into negotiations to settle litigation between Warren James Orovitz and Barry Haiman, as trustees, plaintiffs and the City of�Tamarac, defendents, and WHEREAS, both parties have agreed to certain conditions included in the proposed stip.plated settlement, and NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION.1: That the Assistant City Attorney is hereby authorized to execute a stipulated settlement of the litigation between Warren James Orovitz and Barry Haiman, trustees and the City of Tamarac, Case No. 75-19999, in the Circuit Court of the 17th Judicial Circuit, in and for Broward County, Florida, a copy of which settlement is attached hereto as "Exhibit A". FALCK, Councilman for.,__the City of Tamarac, Defendants : The parties hereto, -by and through their undersigned counsel, i stipulate and agree as follows 11 The Defendants shall dismiss, with preju,dice, their appeal presently pending in the captioned case. 20 The Defendants shall comply with the Circuit Court Is Final: Judgment in the captioned cause, as amended by the Court's Order of. December 16, 1976., except with regard to the western thirty (301) feet of the subject property, and the Final Judgment shall be amended to delete said western thirty (301) feet from the force and effect of said Final Judgment. The western thirty (301) feet shall be measured from the western boundary of the subject property, said boundary being the eastern edge of the existing canal . 3. The Plaintiffs, their heirs, successors or.assigns (.the "Owners".) will apply to rezone -the western thirty (301) feet to the Zoning category- of S-1 (hereinafter the S-1 Property) , subject to the following conditions: ('.a The Owners will not be required to build a seawall � a along the boundary of the S-1 Property.
