2 RESOLUTION NO. 1 -
3 A RESOLUTION GRANTING A RELEASE OF A
PORTION OF UTILITY EASEMENT IN
4 SUNFLOWER 2ND ADDITION
5 WHEREAS, a request has been made by the property owners of Lots 112, 113,
6 114 and 115 of Sunflower 2nd Addition, as recorded in Plat Book 78, Page 50,
7 for the release of the westernmost 6-feet of the existing 12-foot wide utility
8 easement, as it runs parallel to and along with their rear property lines,
9 leaving a continual 6-foot wide utility easement remaining across their property,
10 as shown on Exhibit "A", and
11 WHEREAS, the franchised utility companies that have underground lines and
12 other utility equipment located in the existing 12-foot easement have indicated
13 by letter that they do not require this westernmost 6-feet of that 12-foot
14 easement for the operation or maintenance of said utilities and do not object to
15 its release, and
16 WHEREAS, the City Engineer has determined that there is no foreseeable
17 need for the westernmost 6-feet of said easement for purposes of storm drainage,
18 water, sewer and other City -related purpose, and
19 WHEREAS, the release of this westernmost 6-feet of said easement will
20 allow the homeowners of Lots 112, 113, 114 and 115 to make improvements to their
21 dots to the same extent as their neighboring lots on which only a typical 6-foot
22 wide easement exists.
23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC,
24 FLORIDA:
25 SECTION 1. That the release of the westernmost 6-foot portion of the
26 existing 12-foot wide utility easement, as shown on Exhibit "A", is granted to
27 the property owners of Lots 112, 113, 114 and 115 of Sunflower 2nd Addition, as
2 8 recorded in Plat Book 78, Page 50.
29 SECTION 2. Said release does not affect the existing 6-foot utility
30 easements that run along the side property lines of said lots.
31 SECTION 3. This resolution shall become effective immediately.
