CITY OF TAMARAC, FLORIDA.
RESOLUTION NO. R- 7j9- /3 0
A RESOLUTION VACATING CERTAIN SANITARY SEWER AND
DRAINAGE EASEMENTS, LYING IN SECTION 9, TOWNSHIP
49 SOUTH, RANGE 51 EAST, BROWARD COUNTY, FLORIDA.
WHEREAS, there presently exists certain sanitary sewer and drain
age easements, being legally described as follows:
Those sanitary sewer and drainage easements shown
on Parcels "C" and "D" of the plat of Tamarac Fair-
ways as recorded in Plat Book 81 at Page 36 of the
Public Records of Broward County, Florida. Said
lands situate, lying, and being in Broward County,
Florida.
WHEREAS, the City Council has been requested to vacate said
easements; and
WHEREAS, those utility companies, having an interest in the said,
sanitary sewer easement, have agreed to the vacation of same; and
WHEREAS, the City Council wishes to vacate said easements at a
time after revised easements are dedicated to the City and revised
storm drainage and other utilities are installed and the City.Engin
has approved construction; and
WHEREAS, this vacation in no way affects the designated canal
maintenance easement or the easements designated as utility easements.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That the sanitary sewer and drainage easements, be
legally described as follows:
Those sanitary sewer and drainage easements shown on
Parcels "C" and "D" of the plat of Tamarac Fairways
as recorded in Plat Book 81 at Page 36 of the Public
Records of Broward County, Florida.
Said lands situate, lying and being in Broward County, Florida,
is hereby vacated, with the effective date of this Resolution being
concurrent with the dedication and acceptance of revised utility and
storm drainage easements and the approval by the City Engineer of the
Temp. #1071

completed utilities and storm drainage construction in said revised
easements.
PASSED, ADOPTED AND APPROVED this day of 1978.

VACATION OF EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
FOR VALUE RECEIVED, the undersigned does hereby vacate
and abandon all those certain easements for drainage, utilities
and storm sewers in:
Parcels C and D of Tamarac Fairways accord-
ing to the plat thereof recorded in Plat
Book 81 at Page 36 of the Public Records
of Broward County, Florida,
as delineated in the plat; and does hereby remise, relinquish
and quit -claim unto Shell Oil Company, as owner in fee simple of
said Parcels C and D, all right, title and interest of the under-
signed in and to so much of the land underlying said easements
which lies outside the Canal Maintenance Easement as delineated
in the Plat.
