CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R- 7, /3/
A RESOLUTION GRANTING A REQUEST BY WOODLANDS
HOMEOWNERS ASSOCIATION FOR A WAIVER TO THE
CITY OF TAMARAC SIGN REQUIREMENTS - CHAPTER 21
OF THE CODE OF ORDINANCES.
WHEREAS, the Woodlands Homeowners Association has made request of,
the City Council to grant a waiver to the Chapter 21 of the Code of
Ordinances, claiming hardship, and
WHEREAS, Council has considered said hardship, the same being,
the condition and location of the existing sign is such that the
traffic hazard is created, and
WHEREAS, the City Council has reviewed said request taking into
consideration the hardship as presented by the applicant and wishes to
grant said waiver with certain conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the request of the Woodlands Homeowners Associa-
tion for a waiver from Chapter 21 of the Code; "Signs and Advertising"
as illustrated in Plan B dated May 25, 1978, is hereby granted.
SECTION 2: The conditions, as set forth by Council and agreed to
by the Woodlands Homeowners Association are as follows:
A) Execution of a Hold Harmless Agreement approved by the City
Attorney, a copy of which is attached hereto as Exhibit "A".
B) If the City finds it necessary to remove the sign, the Wood-
lands Homeowners Association would be responsible to remove
the sign at its own expense. If the Association does not
comply, the City reserves the right to demolish the sign.
C) This waiver to erect the sign is revocable at any time Council
deems necessary.
PASSED, ADOPTED AND APPROVED this /-3 day of 1978.

HOLD HARMLESS AGREEMENT
THIS AGREEMENT entered into this � day
of ,A •A; 1978, between the CITY OF TAMARAC, a municipal
corporation of the State of Florida, and WOODLANDS HOMEOWNERS
V
ASSOCIATION.
W I T N E S S E T H:
WHEREAS, Section 21-15 of the Tamarac City
Code authorizes waivers to the City's sign ordinance under
certain conditions; and
WHEREAS, an application for a waiver for an
entrance sign was submitted by the Woodlands Homeowners
Association; and
WHEREAS, said entrance sign would be located
on the public right-of-way; and
WHEREAS, the City Council has considered the
application of the Woodlands Homeowners Association and has
approved same subject to certain conditions.
NOW, THEREFORE, in consideration of the mutual
covenants contained herein, the parties agree as follows:
1. Woodlands Homeowners Association covenants
and agrees to indemnify and hold harmless the City of Tamarac,
its officers, agents and employees for any bodily injuries
that occur as a result of the placement, location, construction
or maintenance of an entrance sign located as shown in Exhibit
"A" attached hereto and incorporated herein.
2. If the City finds it necessary to remove
the sign the Woodlands Homeowners Association will remove the
sign, at its own expense, and if the Association does not
remove the sign, the City is authorized to demolish the sign.
3. The Woodlands Homeowners Association
acknowledges that the authority to erect and maintain the
sign is revocable at the will of the Tamarac City Council.

made and executed this Agreement on the respective days of
each signature.
