R- e-/ A RESOLUTION ACCEPTING A GRANT OF EASEMENT FROM LEADERSHIP HOUBING, INC. FOR DRAINAGE PURPOSES. WHEREAS, Leadership Housing, Inc. has offered to the City of Tamarac a Grant of Easement for drainage purposes, and WHEREAS, the Grant of Easement has been reviewed by the City Attorney and City Engineer, who have issued their recommendations thereon, and WHEREAS, the City Council deems it in the best interest of the City to accept the Grant of Easement. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the Grant of Easement from Leadership Housing, Inc. to the City of Tamarac for drainage purposes, a copy of which is attached hereto and made a part hereof by reference, is hereby accepted. SECTION 2: That the acceptance of this easement shall not be construed to obligate the City with respect to.the installation, repair, maintenance, alteration, and operation of such facilities. SECTION 3: That the City Clerk is hereby instructed to record said Grant of Easement in the Public Records of Broward County, Florida. LEADERSHIP does hereby grant, assign and set over unto CITY an Easement in perpetuity over, under, on and across the Lands for purpose of construction, operating, maintaining, servicing and repairing a storm drainage system and storm drainage lines, as now in existence, or as may hereafter be constructed together with the rights of ingress and egress over the Lands for such purposes. 2. The CITY does hereby accept the foregoing grant of Ease- ment and does agree that it will, in the event of any digging, excavation or construction by the CITY upon the Lands, restore the Lands and the surface cover thereof to the condition as existed immediately prior to such digging, excavation or construction. 3. LEADERSHIP, for itself, its successors and assigns, re- serves the right and privileges to use the Lands for all purposes for which the Lands are being used as of the date hereof, including, but not limited to, all activities incidental to the operation and maintenance of the golf course. N 4. The Easement rights herein granted shall run in favor of the CITY, its successors and assigns.
