HomeMy WebLinkAboutCity of Tamarac Resolution R-78-183Introduced Temp. # AP 63 / R-ev>sed 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 3i 32 33 34 CITY OF TAMARAC, FLORIDA RESOLUTION NO. 2- 7Ez/ _J A RESOLUTION AUTHORIZING THE CORRECTION OF THE OFFICIAL ZONING MAP OF THE CITY OF TAMARAC, FLORIDA, TO REFLECT PROPER ZONING THAT WAS GRANTED CONCERNING ALL OF THAT PORTION OF THE EAST ONE-HALF OF THE NORTHEAST ONE -QUARTER OF THE SOUTHEAST ONE -QUARTER OF SECTION 18, TOWN- SHIP 49 SOUTH, RANGE 42 EAST, LYING SOUTH OF COMMERCIAL BOULEVARD AND LYING WEST OF NORTH- WEST 31ST AVENUE, LESS THE NORTH 150 FEET THERE- OF. .. WHEREAS, the Official Zoning Map of the City of Tamarac was adopted by Resolution No. 78-29, and WHEREAS, it has been discovered that there is an error in the Official Zoning Map of the City of Tamarac, and WHEREAS, the Official Zoning Map of the City of Tamarac indicates that the following described property is zoned R-3 when, in fact, a portion of the property is zoned R-lB and B-1, and WHEREAS, the property that is to be corrected on the Official Zoning Map is the north 150 feet of the east one-half of the northeast one -quarter of the southeast one -quarter of Section 18, Township 49 South, Range 42 East, lying south of Commercial Boulevard and lying west of northwest 31st Avenue, Broward County, Florida. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the Official Zoning Map of the City of Tamarac, as adopted by Resolution No. 78-29, is amended and corrected to show that the north 150 feet of the east one-half of the northeast one -quarter of the southeast one -quarter of Section 18, Township 49 South, Range 42 East, lying south of Commercial Boulevard and lying west of northwest 31st Avenue less the east 250 feet of the north 150 feet of that portion of the east one-half of the northeast one -quarter of the southeast one - quarter of Section 18, Township 49 South, Range 42 East, lying south of Commercial Boulevard right-of-way and west of northwest I 31st Avenue right-of-way is incorrectly shown on the Official 2 Zoning Map as being zoned R-3. This property was incorrectly shown 3 on the Zoning Map as a result of the passage of Ordinance 73-90 4 which did rezone the following described property. 5 ALL of that portion of the east one-half of the 6 northeast one -quarter of the southeast one -quarter of 7 Section 18, Township 49 South, Range 42 East, lying 8 south of Commercial Boulevard and lying West of North- 9 west 31st Avenue, less the north 150 feetthereof. 10 Said land situate lying in Broward County, Florida. 11 SECTION 2: The appropriate officials of the City of 12 Tamarac are directed to correct the Zoning Map as expeditiously 13 as possible to show: 14 (1) The west 53 feet of that portion of the east one-half 15 of the northeast one -quarter of the southeast one -quarter 16 of Section 18, Township 49 South, Range 42 East, lying 17 south of Commercial Boulevard right-of-way to be zoned 18 R-1. Said description being the eastern one-half of the 19 106 foot right-of-way of Northwest 31st Avenue. 20 (2) The east 250 feet of the north 150 feet of that 21 portion of the east one-half of the northeast one -quarter 22 of the southeast one -quarter of Section 18, Township 49 23 South, Range 42 East, lying south of Commercial Boulevard 24 right-of-way and west of Northwest 31st Avenue right-of- 25 way to remain zoned B-1. 26 (3) The north 150 feet, excluding the east 303 feet of 27 that portion of the east one-half of the northeast one- 28 quarter of the southeast one -quarter of Section 18, 29 Township 49 South, Range 42 East, lying south of 30 Commercial Boulevard right-of-way to be zoned Rl-B. 31 (4) All of that portion of the east one-half of the north- 32 east one -quarter of the southeast one -quarter of Section 33 18, Township 49 South, Range 42 East, lying south of 34 Commercial Boulevard and lying west of Northwest 31st -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 Avenue, less the north 150 feet thereof. Said land situate lying in Broward County, Florida to be zoned R-3. SECTION 3: That Exhibit A attached hereto and made a part hereof shows pictorally the proper zoning designations for the property in question. SECTION 4: This Resolution shall take effect immediately upon its final passage.
