R-��� A RESOLUTION OF THE CITY COUNCIL URGING THE BROWARD COUNTY DEPARTMENT OF TRANSPORTATION TO INSTALL TRAFFIC SIGNALS AT CERTAIN LOCA- TIONS ALONG WEST COMMERCIAL BOULEVARD PRIOR TO ITS COMPLETION. WHEREAS, the Broward County Department of Transportation has decided not to install traffic signals along Commercial Boulevard at N. W. 79th Avenue, 84th Terrace and 88th Avenue until after a traffic study is done following the opening of West Commercial Boulevard, and WHEREAS, the best interests of the residents of the City and travelers at large are not being considered in this decision by the Broward County Department of Transportation, and WHEREAS, the City Council, in its desire to protect the health, safety and welfare of the residents of the City, and travelers at large,is very much opposed to the decision of the Broward County Department of Transportation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the City Council hereby strongly urges the Broward County Department of Transportation to reconsider its decision concerning traffic signalization along West Commercial Boulevard at N. Volker, Executive Director C17y a7YOT SUBJECT: Immediate Attention on Sovereign Immunity►' Vote'4Rgc by the Constitution Revision Commission (CRC) We request your immediate attention to the sample letter we have enclosed regarding recent Constitution Revision Commission (CRC) action on sovereign immunity. The original League position supporting a constitutional amendment to treat municipalities the same as the state, counties, school districts, etc. and to authorize the legislature to establish statutory limitations, was amended to repeal sovereign immunity for all political jurisdictions by a 23 - 7 vote. Most recently, a vote to reconsider the repealed amendment was defeated 17 - 16. It is imperative that each member of the CRC indicated by checkmark on the attached list is contacted regarding our position in the attached sample letter. You may want to use some of your own language, since the form letter is intended as a guide only. I suggest that mailgrams or special delivery letters be sent out immediately, as next week (Jan. 23 - 27) is the last time the CRC will be meeting prior to public hearings on their recommendations. a � Bill lii inui '6 ���''BROWARD COUNTY LEAGUE of CITIES Ig ii 2800 WEST OAKLAND PARK BOULEVARD • OAKLAND PARK • FLORIDA • 33311 • (305) 484-9528 SAMPLE LETTER Dear As an elected official I am appalled at your voting record in favor of a constitutional amendment which would repeal sovereign immunity for the state, counties, municipalities, school districts and other political jurisdictions. It is obvious you haven't given full consideration to the catastrophic impact the repeal of sovereign immunity would have on the taxpayers of Florida in the form of skyrocketing insurance premiums. You need only look at the rising trends in the cost of general liability insurance over the past several years to realize that any relaxation of the current statutory limitations we have fought so hard for, would be disastrous. This is not to say that personal injuries caused by negligence on the part of any political jurisdiction should not be fully compensated. To the contrary, any public entity should be prepared to face the full brunt of obvious negligence. However, the taxpayers of these same jurisdictions should not be subjected to the rash of speculative damage claims and multimillion dollar law suits that repeal would surely bring. I plead with you to consider once again all the ramifications of this potentially damaging amendment. Finally, I request that you do every- thing in your power to see that Proposal 98, or any subsequent proposal which would have the same effect is struck before it reaches the ballot. R-78-27 and R-78-28 regard- ing traffic signalization at a number of intersections along Commercial Boulevard and Pine Island Road within the City of Tamarac. This Division is currently completing the necessary design plans to install new traffic signalization along Commercial Boulevard at N.W. 64th Avenue, N.W. 70th Avenue, and N.W. 88th Avenue (Pine Island Road). The construction project also includes signalization at University Drive and Commercial Boulevard. We will re -study the other intersections listed in the above referenced Resolutions to determine if any of the warrants for signalization are met.
