CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R- _ p
A RESOLUTION AUTHORIZING THE MAYOR TO
EXECUTE A RELEASE AND CANCELLATION OF
COVENANT WITH H.L.R., INC. AND LEADER-
SHIP HOUSING, INC. FOR LOT 71, COLONY
WEST ESTATES (WESTCHESTER).
WHEREAS, Leadership Housing, Inc. did execute and deliver
to the City of Tamarac that certain covenant dated July 26, 1976
and filed February 11, 1977 in Book 6907, Page 46 of the Official
Records of Broward County, Florida, pertaining to the lands des-
cribed in said covenant as Exhibit A; and
WHEREAS, Leadership Housing, Inc. the owner of the lands
described in Exhibit A attached to said covenant, and H.L.R., Inc.,
the owner of Lots 1 thru 70, both inclusive, of Colony West Estates
according to the Plat thereof recorded in Plat Book 91, Page 19
of the Public Records of Broward County, Florida are now requesting
the City Council to release said covenant; and
WHEREAS, the City Council having accepted a recreation fee
submitted in lieu of dedication of a recreation parcel, and
WHEREAS, the City Council having considered said request wishes
to release said covenant.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the Mayor is hereby authorized to execute on
behalf of the City a release and Cancellation of Covenant releasing
that certain covenant filed February 11, 1977 in Book 6907, Page 46
of the Official Records of Broward County, Florida.
PASSED, ADOPTED AND APPROVED thisday of 1978.

RELEASE AND CANCELLATION OF COVENANT
KNOW ALL MEN BY THESE PRESENTS, That:
WHEREAS, LEADERSHIP HOUSING, INC., a Delaware corp-
oration, by an instrument dated July ;6, 1976, and filed February
11, 1977, in Book 6907, Page 46 of the Official Records of Broward
County, Florida, did covenant with the City of Tamarac, pursuant to
Ordinance No. 72-31, that the lands described on Schedule "A"
attached hereto and made a pant hereof be used for recreational
purposes for the benefit of the owners of the property located in
COLONY WEST ESTATES, according to the Plat thereof recorded in Plat
Book 91, Page 19 of the Public Records of Broward County, Florida;
and
WHEREAS, HLR, INC., a Florida corporation, is the owner
of Lots 1 thru 70, both inclusive, of COLONY WEST ESTATES, and is
agreeable to and willing to release and cancel the aforementioned
covenant, which covenant affects a part of Lot 71 of COLONY WEST
ESTATES; and
WHEREAS, LEADERSHIP HOUSING, INC. is the owner of Lot 71
of COLONY WEST ESTATES and is agreeable to and willing to release
and cancel the aforementioned covenant, which covenant affects a
part of Lot 71 of COLONY WEST ESTATES; and
WHEREAS, the CITY OF TAMARAC is agreeable to and willing
to release and cancel the aforementioned covenant.
NOW, THEREFORE, in consideration of the premises, the
parties hereto do hereby remise, release, quit -claim, exonerate,
discharge and cancel the Covenant recorded in Book 6907, Page 46 of
the Official Records of Broward County, Florida, as the same
effects the property described in Schecule "A" attached hereto.
IN WITNESS WHEREOF, the parties have hereunto set their
hands and seals this &/Sc day of January, 1978.
