CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-78-75
A RESOLUTION CONCERNING HOUSE BILL 889 AND
SENATE BILL 231 - THE PRIVATE PROPERTY RIGHTS
BILL - STRONGLY URGING REJECTION OF THIS PRO-
POSED LEGISLATION BY THE MEMBERS OF THE BROWARD
COUNTY LEGISLATIVE DELEGATION, ALL APPROPRIATE
LEGISLATIVE COMMITTEES AND BOTH HOUSES OF THE
FLORIDA LEGISLATURE.
WHEREAS, House Bill 889 and Senate Bill 231 - The
Private Property Rights Bill - has been proposed for consideration
by the Florida Legislature, and
WHEREAS, this proposed legislation has been considered
by the members of the City Council of the City of Tamarac, and
WHEREAS, it is the opinion of the City Council of the
City of Tamarac that the rights and remedies provided land owners
in said bill are excessive and potentially dangerous for the City
of Tamarac in particular and all municipalities in general, and
WHEREAS, the Council believes that land owners already
have appropriate access to the judicial process for hearing of
complaints, and
WHEREAS, the wording of the legislation proposed is overly
broad in effect, granting a cause of action to any land owner,
thereby encouraging multiple and overburdensome litigation with
respect to legitimate municipal land planning, and
WHEREAS, the Council of the City of Tamarac finds this
proposed legislation to be intensely onerous to the philosophy
of municipal land planning and the rights of the municipality to
self -determine the quality of life it wishes to provide its citizens.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the City Council of the City of Tamarac
hereby condemns the philosophy of the proposed legislation and
urges rejection of the same
SECTION 2:
That a copy of this Resolution be forwarded
to all municipalities in Broward County, all members of the
Broward County Legislative Delegation, the Majority and
Minority Leaders of the Florida House, the Majority and Minority
Leaders of the Florida Senate, Governor Askew and all members
of the Florida Cabinet.
