R A RESOLUTION PROVIDING FOR A SPECIAL EXCEPTION TO PERMIT A RACQUET BALL CLUB IN AN EXISTING B-2 ZONING DISTRICT, PURSUANT TO ORDINANCES 73-60, 76-23, 77-9, AND 77-15, THE SAME BEING CHAPTER 28 OF THE TAMARAC CITY CODE; PROVIDING CONDITIONS OF APPROVAL, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, public notice has been given in accordance with the applicable law of the time and place of public hearing regarding Special Exception Petition #8-Z-78 to permit a Racquet Ball Club in an existing B-2 zoning district on property described herein, and WHEREAS, the public hearing has been held on Petition #8-Z-78 by the City Council on April 24, 1978, and the public has been given an opportunity to be and has been heard, and WHEREAS, the City Council has examined and investigated the request for the Special Exception and has reviewed the recommendations of the Planning Commission of the City of Tamarac, and WHEREAS, the City Council deems that the public health, safety, morals and general welfare of the public would not be adversely affected by granting such Special Exception. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION ONE: That those lands described in Exhibit "A" attached hereto and made a part hereof are hereby granted a Special Exception for use as a Racquet Ball Club. SECTION TWO: That approval of Special Exception Petition #8-Z-78 shall be valid for a period of one (1) year following the date of this approval, and thereafter shall become<_null and void, unless construction of the use is substantially underway during said one (1) year period, or unless an extension of time is approved before the expiration of said one (1) year period.
