WHEREAS, an application has been made by the Mobil Oil Company for a waiver of the City's sign ordinance for moving an existing, non -conforming, sign and to move said sign; and, WHEREAS, the moving of said sign is dictated by the widening of Commercial Boulevard; and WHEREAS, the granting of said waiver is in the best interest of the citizens of said City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1. That pursuant to the terms of Section 21-15 of the Tamarac City Code, a waiver is granted to the Mobil Oil Company for the movement of its existing sign from the Northeast corner of Commercial Boulevard and State Road 7 to a site that will be just outside of the publically dedicated right-of-way and on the property of Mobil Oil along Commercial Boulevard. SECTION 2. The conditions of the granting of this waiver are as follows: 1) That the sign cannot rotate or be movable; it's got to be stationary. 2) That the sign does not project over the property line in -any part of it. 3) That proper traffic protective devices such as curbing be installed (but not poured pedestal). 4) The sign be moved to the most northerly point, within the curbed area, and the Chief Building Official follow up on this condition. 5) The Beautification to be installed to the satisfaction of the City Planner. 6) In re: affect of granting of this waiver on eminent domain/ condemnation proceeding, as stated in the record by Attorney Hugh Glickstein, representing Mobil Oil; "The purpose is to eliminate the issue of the costs of relocation of the pump island with the accompanying loss to the property owner of one of its service bays By relocating the sign, in the area which is under discussion to- day and in the same form that the sign. presently exists, we will M Temp. SECTION 3. This Resolution shall become effective immediately.
