R- 79-// 3 A RESOLUTION GRANTING A LIMITED WAIVER OF PARKING AND LOADING REQUIREMENTS. 4 5 WHEREAS, Ordinance 78-62 authorizes the issuance of a 6 limited waiver from the parking requirements in. Chapter 18 of the 7 Tamarac City Code, and 8 WHEREAS, a Public Hearing has been held before the Planning 9 Commission concerning an application made by Club Shopping Plaza 10 on January 4, 1979, and 11 WHEREAS, the Planning Commission has recommended granting of 12 application, and 13 WHEREAS, a Public Hearing has been duly advertised and held 14 before the City Council of the City of Tamarac on January 24, 1979, 15 and 16 WHEREAS, the City Council desires to grant said application. ( 17 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 18- CITY OF TAMARAC, FLORIDA: 19 SECTION lr That the application for a limited waiver of 20 the provisions of Chapter 18 of the City Code pertaining to parking 21 made by Club Shopping Plaza on January 4, 1979 is hereby granted. 22 This waiver is to allow a reduction of required spaces from 73 to 68. 23 SECTION 2• The City Council makes the following finding: 24 a. That granting of the limited waiver is the minimum 25 waiver that will make possible the reasonable use of the 26 land, building or structure. 27 b. That granting of the limited waiver will be in 28 harmony with the general intent and purpose of this Chapter r 29 and other ordinances and that such limited waiver will not- t 30 be injurious to the area involved or otherwise detrimental 31 to the public welfare. 32' C. That the hardship found is the request of the City to keep the access to the adjacent property (Steak & Ale Restuarant)open to serve the health safety and welfare of the public. e. That.the hardship is not self imposed. SECTION 3: That Club Shopping Plaza Associates shall provide the City with a recordable, legal document stating that if the ingress/egress shown on the site plan, file 71-77, granted by Ferguson, Glasgow, Shuster is revoked that Club Shopping Plaza Ass- ociates shall provide the required parking spaces, at the time, within 90 days of the loss of the ingress. If the City Attorney deems it necessary for a bilateral agreement with the City, the Appropriate City Officials are authorized to execute such agreement. SECTION 4: This Resolution shall be effective immediately upon its approval by the City Council.
