Reso. 1169 CITY OF TAMARAC, FLORIDA RESOLUTION No. A RESOLUTION APPROVING A SPECIAL EXCEPTION TO PERMIT A FUNERAL HOME IN AN EXISTING B-1 ZONING DISTRICT CLOCATED IN TRACT 15, LAND SECTION 10, TOWNSHIP 49 SOUTH, RANGE -41 EAST, LOCATED ON SOUTH SIDE OF N. W. 57th STREET APPROXIMATELY 6700 WEST): PURSUANT TO ORDI NANCE NO. 76-23, THE SAME BEING SECTION .28-197 OF THE TAMARAC CITY CODE; PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instruction of the City Council of the: City of Tamarac, Florida, public notice has been given in accordance with_ the applicable law of the time and place of public hearing regarding the Special Exception to permit a funeral home in an existtng B-1 zoning district on property described herein, and the: said. publ tc. heari:ng h:as been held in accordance with the notice and the public h-as been given an opportunity to be, and h-as been heard; and th.e Council has examined and investigated the request for th-e Special Exception herein and has received the recommendation of the Planning Commission of the City of Tamarac; and WHEREAS, the public hearing has been held on Petition No. 33-Z,78 by th-e City Council pursuant to the Charter; and WHEREAS, the- City Council deems that the public health, safety, morals and general welfare of the public would not be adversely affected by grantingsuchSpecial Exception. NOW, TKE;REFORE, BE IT RESOLVED BY THE COUNCIL OF TH-E, CITY OF TAMARAC, FLORIDA: SECTION 1:That those lands described in Exh_i.h-i;t "A" attached hereto and made a part hereof are hereby granted a Special Exceptton for use as a funeral home, with the following conditions: 1) Only one Chapel (2) No crematory (3) Receipt of fully recordable development agreement, pursuant to the Land' Use Plan. 1 2 3 4 i 5 6 7 8 9 10 11 12 13 14 15 ]6 17 18 19 20 21 22 23 24 25 26 27 28 29 (f 30 31 32 33 34 SECTION 2: That approval of a Special Exception shall be valid for a period of one year following the date of ap- proval, and thereafter shall become null and void unless con- struction or use is substantially underway during said one year period, or unless an extension of time is approved by the Planning Commission before the expiration of said one year period. SECTION 3: This Resolution shall become effective immediately upon receipt of fully recordable development agreements, pursuant to the Land Use Plan. PASSED, ADOPTED AND APPROVED this day of 1979.
