CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-
A RESOLUTION URGING THE BROWARD COUNTY
COMMISSION TO WAIVE THE REQUIREMENT OF
PLATTING PUBLICLY OWNED LAND AS A CONDI-
TION PRECEDENT TO OBTAINING A BUILDING
PERMIT FOR THE ERECTION OF A PRINCIPAL
BUILDING THEREON.
WHEREAS, Chapter IV, Section 5.02 of the Broward County
Land Use Plan prohibits any unit of local government entity from
issuing a building permit for the construction of a principal build=
ing on a parcel of land unless a plat therefor -has been approved by
the County Commission and recorded in the Official Records of Broward
County; and
WHEREAS, the Office of the General Counsel for the County
has interpreted said Chapter IV, Section 5.02 of the Broward County
Land Use Plan so as to require platting of lands owned by govern-
mental entities as well as the platting of privately owned lands;
and
WHEREAS, said Chapter IV, Section 5.02 of the Broward County
Land Use Plan has exceptions to such platting fof single-family lots,
or multiple -family or non-residential parcels less than five (5)
acres in size, so long as any land necessary to comply with the
Trafficways Plan of the Planning Council has been conveyed to the
public by deed or grant of easement; and
WHEREAS, there is no apparent justification or distinction
that can be made between a non-residential parcel, less than five (5)
acres in size (on which no plat would be required), or more than
five (5) acres in size (on which the County would require platting)
where the land is owned by a governmental entity; and
WHEREAS, the City of Tamarac has determined the platting
costs for local governments to plat their land holdings of more than
five (5) acres in size, would cause an unnecessary expenditure of
tax revenue (in that all such governmentally -owned lands are already
held in trust for the public, and plats are not needed in order to

convey from one level of government to another easement or mainte-
nance rights where deemed necessary or appropriate);
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA, THAT:
1. The Broward County Commission either interpret
Chapter IV, Section 5.02 of the Broward County
Land Use Plan as being limited in application ,
to privately owned land, or alternatively that
said subsection of the County Land Use Plan be
amended to expressly exclude from platting re-
quirements lands owned by local governmental
entities so as to avoid an unnecessary expendi-
ture of tax revenues raised from the citizens
of Broward County, Florida, as a condition
precedent to issuing building permits thereon..
2. A certified Copy of this resolution shall be
forthwith delivered to each County Commissioner.
3. A Certified Copy of this resolution be delivered
to each other unit of local government in Broward
County, Florida, and to the Broward County League
of Cities, with a request that such other units
of local government consider passing similar re-
solutions encouraging the Broward County Commis-
sion to waive the platting of land owned by local
governmental units as a condition precedent to
issuing building permits thereon.
