CITY OF TAMARAC, FLORIDA
RESOLUTION NO. k" -c-�Icq
A RESOLUTION VACATING A CANAL EASEMENT LOCATED AT
LOT 8, WOODMONT TRACT 53 ACCORDING TO THE PLAT
THEREOF, IN PLAT BOOK 95, PAGE 11, OF THE PUBLIC
RECORDS OF BROWARD COUNTY, FLORIDA, LOCATED AT
7852 NUTMEG COURT. TAMARAC. FLORIDA.
WHEREAS, the property described in Exhibit A attached hereto and
made a part hereof was originally dedicated to the public for4 canal easement
in the Woodmont Tract 53 Subdivision (PB 95, P 11 Public Records of Broward
County), and
WHEREAS, no canal has been constructed on said property or is con-
templated to be constructed on said property, and
WHEREAS, an application has been filed by Steven A. Ostrow and
Carol Lynn Ostrow who own the property on which the e&ement exists and was joined
in by the mortgage holder on the property, and
WHEREAS, further ownership of said easement will not benefit the
health, safety or welfare of the citizens of Tamarac.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That property described in Exhibit A attached hereto
and made a part hereof is vacated by the City of Tamarac which renounces any
claim of ownership to said property.
SECTION 2: The City of Tamarac is cognizant of the requirements of
Section 177.101 F.S. and Chapter 28946 Laws of Florida, Special Acts of 1953, as
amended from time to time, which sets forth a procedure for partial vacation
dedications granted in plats and this vacation is contingent upon approval by the
Broward County Board of County Commissioners and satisfaction of all requirements
of Section 177.101 F.S. and Chapter 28946 Laws of Florida, Special Acts of 1953,
as amended fron time to time.
