A RESOLUTION VACATING A PORTION OF WOODMONT TRACT 64 AS RECORDED IN PLAT BOOK 95 PAGE 40, SPECIFICALLY THOSE 50 FOOT WIDE ROAD RIGHTS -OF -WAY SHOWN AS BLACK OLIVE ROAD, AVENUE AND DRIVE, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, LOCATED NORTH OF SEVENTY FIFTH STREET BETWEEN 80TH AND 88TH AVENUES WHICH PROPERTY HAD ORIGINALLY BEEN DEDICATED TO THE PUBLIC FOR ROAD RIGHT-OF-WAY PURPOSES IN THE WOODMONT TRACT 64 SUBDIVISION; AND PRO- VIDING AN EFFECTIVE DATE. WHEREAS, the 50 foot wide road rights -of -way named Black Olive Road, Avenue and Drive were originally dedicated to the public for road right-of-way purposes in the Woodmont Tract 64 Subdivision (PB 95, P 40 Public Records of Broward County), and WHEREAS, an application has been filed on behalf of Woodmont Land Trust I which owns property on both sides of said right-of-way for its vacation in order that the street shall become a private street, and WHEREAS, the vacation will not affect the ownership or right of convenient access of persons within the subdivision, and WHEREAS, the applicant has met the requirements of Tamarac City Ordinance No. 79-26 pertaining to private streets; and WHEREAS, further ownership of said right-of-way will not benefit the health, safety or welfare of the citizens of Tamarac. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the 50 foot wide road rights -of -way named Black Olive Road, Avenue and Drive as shown in the Woodmont Tract 64 Subdivision (PB 95, P 40 Public Records of Broward County) is vacated by the City of Tamarac which renounces any claim of ownership to said property. SECTION 2: The City of Tamarac is cognizant of the requirements of Section 177.101 F.S., and Chapter 28946 Laws of Florida, Special Acts of 1953, as amended from time to time, which sets forth a procedure for partial vacation dedications granted in plats and this vacation is contingent upon approval by the Broward County Board of County Commissioners and satisfaction of all requirements of Section 177.101 F.S., and Chapter 28946 Laws of Florida, Special Acts of 1953, as amended from time to time.
