R- 7 - j?S'F!� A RESOLUTION APPROVING A SPECIAL EXCEPTION TO PERMIT A FUNERAL HOME IN AN EXISTING B-6 ZONING DISTRICT (LOCATED ON LOTS 3 AND 4, BLOCK 34, MCNAB COMMERCIAL SUBDIVISION #2, ADJACENT TO SUNNILAND BANK); PURSUANT TO CHAPTER 28 OF THE TAMARAC CITY CODE; PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instruction of the City Council of the City of Tamarac, Florida, public notice has been given in accordance with the applicable law of the time and place of public hearing regarding the Special Exception to permit a funeral home in an existing B-6 zoning district on property described herein, and the said public hearing has been held in accordance with the notice and the public has been given an opportunity to be, and has been heard; and the Council has examined and investigated the request for the Special Exception herein and has received the recommendation of the Planning Commission of the City of Tamarac; and e WHEREAS, the public hearing has been held on Petition No. 18—Z-79 by the City Council pursuant to the Charter; and WHEREAS, the City Council deems that the public health, safety, morals and general welfare of the public would not be adversely affected by granting such Special Exception. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That those lands described in Exhibit "A" attached hereto and made a part hereof are hereby granted a Special Exception for use as a funeral home with the following conditions: 1. Only one (1) chapel 2. No Crematorium 3. Water & Sewer E.R.C.'s available. SECTION 2: That approval of a Special Exception shall e valid for a period of one year following the date of approval, I V 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 and thereafter shall become null and void unless construction or use is substantially underway during said one year period, or unless an extension of time is approved by the Planning Commission before the expiration of said one year period. , SECTION 3: This Resolution shall become et't'ective immediately upon receipt of fully recordable development agreements, pursuant to the Land Use Plan.
