CITY OF TAMARAC, FLORIDA
RESOLUTION N0. 79 02g
A RESOLUTION SUPPORTING THE PROPOSED ORDINANCE
BEFORE THE BROWARD COUNTY COMMISSION WHICH WOULD
REQUIRE DEVELOPERS OF REAL PROPERTY OTHER THAN
CONDOMINIUM PARCELS TO PLACE SALES DEPOSITS IN
ESCROW PRIOR TO CLOSING WHEN DEPOSITS ARE LESS
THAN 10% OF THE SALES PRICE AND LIMITING USE OF
DEPOSITS IN EXCESS OF 10% OF THE SALE PRICE.
WHEREAS, there is currently pending before the Broward County
Commission an ordinance which would require Developers to place in escrow deposits
on sale contracts for real property other than condominimum parcels when said
deposits are less than 10% of the sales price, and
WHEREAS, said ordin.ance would also strictly control the use of
deposits in excess of 10%, and
WHEREAS, throughout the years in Broward County and throughout the
Country many purchasers have lost their life savings by placing security deposits
on property which is never developed and which deposits are spent, and
WHEREAS, it is deemed necessary for government to set some
controls concerning the use of deposit monies.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: That the City of Tamarac supports the adoption
of an ordinance along the lines of the proposed County ordinance to require
sales, contract fees on real property other than condominium parcels to be
escrowed and otherwise to control the use of these funds.
SECTION 2: That a copy of this Resolution shall be forwarded
to the Broward County Commission and to all municipalities within Broward
County and the Broward League of Cities.
SECTION 3: This Resolution shall become effective upon adoptio .
